For the person who said they don’t carry much weight -they absolutely do carry weight. We had the best lawyers in our state review the noncompete and they told us we were all good to continue with the hiring. Got sued, 600k case. Lost.

Depends on the company, the state, but it’s not something I would ever take a chance with

Non-Competes for anyone less than C level is absurd, and even then, I still think they are d-mb. But for a corporate C level employee, even when they "leave for other opportunities" or fake retire, they are packaged out with very large sums of money and will land just fine, be able to pay their bills and likely have the benefit of a year long vacation I suppose. But the rest of us, obviously that is not the case. IMO this really is great for the rest of the country (good on CA for already getting there). Although I'll assume someone is going to try and challenge it in court, it will probably hold up. However, for the person who mentioned they don't hold up in court anyway, while that may be true, it's often the case that the hiring company doesn't want to go to court for you. The hiring company will also receive a letter that they will be sued as well if they continue your employment. So then if the hiring company does not want to go to bat for you, it's up to the individual if it's worth the large expense and time it takes to go up against very seasoned corporate lawyers in court or just wait out the 1 year period.

Does the severance policy still have non-compete language in it?

Noncompetes are already illegal in California.
