Coincidence or trend?

Are you more at risk for lay off or “forced” exit if you are over 40 years old?

I understand the economics of employing more experienced workers (correlated to age).

However, with the number of over 40 people being impacted, it make me wonder how they are covering their rear ends from ADEA.

The Age Discrimination in Employment Act of 1967 (ADEA) protects certain applicants and employees 40 years of age and older from discrimination on the basis of age in hiring, promotion, discharge, compensation, or terms, conditions or privileges of employment.

If you are over 50, you are at high risk. I was part of the layoffs in October. When this happens, they have to provide documentation of the roles laid off, the ages, etc. On that round, most of the people were 50 and over, not many under 40 but a few were let go.
How does this happen and how is this allowed? People say you do not have to sign severance and take legal action. 2 things, one, people need income and this will get drawn out. Second, do you really want to fight and sue because they will have to give your job back and would you really want to go work for a company that was planning to cut you off? I wouldn't, I moved on and like I always say, karm is a you know what and it'll get them at some point.

It all comes down to the dreaded 9 Box.

The most desired employees are in the top right quadrant.

This impacts age 50+ employees negatively because the “potential” part of the calculation has expired for them. “They are what they are” as they say.

An employee who has gotten 20 years of 2-3% raises is probably making more than most of their teammates. Combine that with no longer being viewed as having “potential” and you have a problem.

I’m not saying I agree with this, so don’t downvote me into last year. I’m just telling you that this is how it is.

Just my thoughts, but I’m thinking for every 5 or more aged 40, 50, 60 something or more long-term tenured employees, one younger aged employee is JE’d. Probably how they are protected themselves. The other thing is, you’d have to not accept severance if you plan on any age discrimination legal action. This is all so stressful and distracting; makes it really hard to stay focused on my work, wondering if I’m next. I call Thursdays “Dead Man Walking”.
