Thread regarding Mattel Inc. layoffs

Fisher Price WARN Act Violation

It doesn't appear that there was a notification to the Department of Labor per the WARN Act for these layoffs.

"The New York State WARN Act requires businesses to give early warning of closing and layoffs. Businesses that do not provide notice may be required to:

  • Pay back wages and benefits to employees
  • Pay a civil penalty"

Has anyone looked into this?

Warn Act: you cannot fire X% percentage of workforce w/o notice. Mattel, OK, so % equals 80 employees, we'll cut 79 jobs

Not a violation: the cuts were less than one-third of EAs total workforce...

"The WARN Act requires employers with 100 or more full-time employees (not counting workers who have fewer than 6 months on the job) to provide at least 60 calendar days advance written notice of a worksite closing affecting 50 or more employees, or a mass layoff affecting at least 50 employees and 1/3 of the worksite’s total workforce or 500 or more employees at the single site of employment during any 90-day period."

I'm guessing this wasn't for the 2024 layoffs, should still have had a separate notification for this one.
