Payoff

The idea around the generous payoff is that you accept it and just leave quietly with a generous sum of money rather than go legal, potentially winning, against what could be deemed discriminatory Cisco LR tactics bringing Cisco into disrepute. If Cisco shrink the packages too much it will encourage people not to sign the disclaimer and go legal.

Someone makes this post every round. You might be able to pull it off, but know HR, legal and a paper trail you've likely never seen have already formed a mountain of evidence to support their side. In software it's very easy for driven kids a few years out of college to outproduce run of the mill old people for far less money and that's a legal value argument, not illegal age discrimination. Likewise if you just did a TOI from a remote site to San Jose or Bangalore there is a good chance your whole group is getting laid off for "business reasons" which is also not illegal discrimination.

A rare few might have real cases but get quality legal advice before declaring war against an employer laying you off.

On the package decreasing, I continue to ask people to show the actual packages over the years and show they are decreasing and it's been complete silence.

Not legal advice or condoning legal action here.

But I’d imagine Cisco has “off the record” conversations about who to LR. Specifically targeted against those who don’t fit a particular… metric. I wouldn’t be surprised if discovery found allusions to it in emails or internal HR docs. A deposition might uncover those conversations.

If, and that’s a big if, you could even remotely conclude illegal behavior then you’d likely get a nice settlement to avoid bad publicity. Bad part would be that it just allows the cycle to continue.

Exactly.
But even though the win probability’s probably is high, no regular engineers have the stomach to face this behemoth at court with time and legal fees required.
Easiest way is just to take the package, forfeit your rights to sue, and move on.

There is no discrimination when it comes to LR, is really BS to the max.
