Has anyone in the August Layoffs (Last active day 10/06/2023) having issues with their bonus?

I was a part of the August lay offs (last active day 10/06/2023) and was assured by my People Leader who was the COO of the Health Plan in NY and also the Senior HR Business partner that I would get my full bonus. I should have received it no later then 30 days after my severance payout which 30 days is 12/10/2023 and never received it however I did get the blank type "normal" $0 earning statement on 12/22/2023. I contacted HR Severance Partners who said I will need to contact payroll as only they have that information and when I contacted Payroll they advised I should be getting it soonish but only the HR Severance Partners know that information. Thankfully Payroll did push it up to their leadership but its been 9 days and still waiting on an answer. HR Severance did get back to me with more information and advised me that "The position level you were in is not eligible for bonus, this is related to position level only, not related to the reduction in force. Employees remaining at that same position level are also not eligible.". I was a Business Analyst Pay Grade L and when I was active I never received any communication about this and after leaving also never received communication on that news. The Severance Agreement I signed stated I was eligible and will be receiving it and the COO and HR Business Partner assured I will be getting the bonus.

In my opinion, the best definition of a bonus can be found here [https://www.investopedia.com/terms/b/bonus.asp]: "A bonus is any financial compensation, reward, or return over and above the normal expectations of the recipient." Bonuses should never be expected from an employer, especially, in my opinion, an incorporated one based in the United States.

No bonus for year 2024 and going forward however the 2023 year bonus will be paid out in 2024 for all active employees. Those that were laid off and worked past 09/01/2023 will receive their bonus within 30 days of severance pay out.

Does is say bonus "if eligible" on the letter? If you were not eligible before you would not be eligible upon layoff. The whole org was made aware of bonuses being taken away from L and lower in 2022 and many times after. Includinging the mention in all HR documents and policies accessible by all employees.

If in your severance agreement I would point that out to HR. Regardless of policy that’s binding. Just be sure it said you were eligible.

Interesting to hear that, that was the game plan for 2024 from my understanding and going forward but to switch it up end of 2023 and eliminate a large amount of employees 2023 bonuses is just immoral. On top of eliminating the active employees bonus eligibility they then go ahead eliminate laid off employees bonus without telling them, I knew a few people that were depending on that bonus both active and inactive. Once I hear back from my health plan HR Business Partners I will repost what I found out. Funny when my health plan was taken over 5 years going my contract clearly stated a 6% minimum increase in pay yearly but the next year it 2.875% and they said that was top tier and the employment contract was subject to change at discretion of the company.

They changed it a while ago. Only grade M and above get a bonus now. Everyone below M was supposed to get a 5 percent raise when they made the change, I believe.

My understanding is that L grade non supervisor and above did not get bonuses
