I wouldn't say doomed company gave us a contract no involuntary layoffs for 6months and a cola!

And it's the wrong horse! Ha ha.
Avayas space is more layered and broken than they presumed. They have to spend more than they planned to in bankruptcy factory resources.
They still get to milk assets and reoccurring revenue as was the objective.
If you think Apollo gambled on the wrong horse, you don't realize the game being played...it's not about growth.

This is interesting will there be a new HQ in Germany? Where will it be? Do you have a link to the law you referenced?
Germany is set up in regions. Each region has its own unique set of governance depending on economic variables.
Avayas current location is in a region that has strict rules when it comes to employee end of service and local taxes, fees and fines.
The Apollo machine knows how to get around this by attempting to relocate an office into a more "corporate friendly" region. This saves Avaya officers and owners tens of millions of dollars.
It's all part of the plan. It just takes many steps to pull it off. Let's hope local employees speak up and stop SS and DA from executing the scam.

Does anyone have more details on "relocating AVAYA offices to new regions in Germany"?
Ms. SS Chief Administrative Officer turned Chief Special Projects is leading the charge to"get rid of as many people possible AND avoid paying them their full legal right to a full package AND regional government penalties".
This involves attempting to "relocate" Avaya offices to a new region in Germany that gives Avaya (& the usual Apollo suspects such as Alix Partners, a la Becky Roof) more latitude to pulling off their objective.
Local employees should engage local authorities & become familiar with the German Termination Protection Act.
Avaya is still required to disclose financials to lenders, even as a post bankrupt, private organization.
It's not pretty. Layoffs will be an ongoing reality in US. Consolidation & shifting staffing in EU will be a reality but likely addressed within next 6 mos.
Avaya has no option. They can't have expenses greater than revenue. Apollo/Brigade demand to benefit from Avaya base and assets, and will su-k out value each quarter. To make this possible, while also hiring "friends", they must continuously rotate out employees (US), get out from under country laws to make the formula work in some EU Countries.
Revenue is NOT meeting it's mark to enable Apollo to profit -- it's just not possible with customers and prospects disengaging from Avaya.
