Thread regarding T-Mobile layoffs

Major illness, received sustantial Reasonable Accomodation as per ADA

Accomodation was WFH for home for another year. Meticulously documented. Now laid off. Would it be wise for me to contact an employment lawyer to see if there was any discrimination involved in the layoff for me? I heard they were using remote status as a factor, but in my case they were specificalled barred from my disability and accomodation used as a factor. Maybe a lawyer can dig out a case. Thoughts?

Don't waste your time, all layoffs are vetted by a T-Mobile lawyer prior to making the decision to impact the person. They look at your race, gender, age, and any disabilities. A fly doesn't land on a sack of sh@t at T-Mobile without a lawyer approving it first. You'll get nowhere with a attorney, might as well put that energy towards mental recovery and job hunting.

To know if you were targeted you'd have to ask yourself a few things. Where you the only one in your department that got let go? Did you get terminated or was your position eliminated? Was there a sudden change in how management treated you? So many factors. There are a lot of remote status positions/employees, there were have to be not one remote employee left after all of this.

First, aim sorry to hear you're laid off and wish you the best with your health. Remote status has not been a factor. Reductions have to happen, regardless of accomodations. Some decisions are made based on role eliminations. Others on performance of leaders must simply reduce their team size by a percentage. Since many teams were already reduced previously, they're not even down to low performers, so it gets very difficult. However, leaders are typically just trying to end up with the strongest possible team. If you have a role that others have in the same team, your leader had to submit an assessment of all like roles justifying the decision. These assessments undergo HR and Legal reviews to ensure there was no bias or discrimination involved. Only after that passes, are specific layoff decisions approved. Long story short, I'm sure the scenario you're contemplating was already considered a potential risk, but it was deemed justified based on your performance relative to peers.
