Severance if unable to take unemployment

Assuming someone is out on or about to be out on FLMA for something that means they cannot work. Physically unable. Legally they cannot take unemployment.

Any insight on whether its true they are requiring unemployment to get severance and if anyone has faced this and how has Anthem/Elevance handled it?

Same question for people that have a second PRN job. Can’t get unemployment because technically you are employed so can’t get severance.

  • Had anthem laid you off while on fmla/std recently?-

Not laid off but group is on the chopping block prior to FLMA, they can legally lay off even with FLMA so that is not the issue. The issue is that if medically unable to work (partial reason for FLMA leave) you cannot collect unemployment.

So if they aren't paying severance to people who don't go on unemployment then for any period you are medically unable to work you are now unemployed, can't get a new job, can't get unemployment and can't get severance.
