HR works like the devious little trolls they are to make sure Big Elephant has many different ways to get rid of you. Nobody there has any morals.

Usually you’re the first to go. It is legal in a RIF

Ive seen people get a phone call while they were on PTO and another off on medical leave.

However I’ve seen some wait for the associate to return from PTO and then they got Riffed.

I guess it depends on how much of a jerk the leadership team is who is making the cuts.

It will not prevent you from being cut.

My wife was cut while on maternity. I spoke to the ACLU a few times. Given that it was done and other individuals were also cut, it was perfectly legal.

Maybe. I've seen a few people skate because they were out on FMLA, only to get rolled up into the next one.

But I've also seen people out on leave get riffed while out, especially if their FMLA has transitioned to STD.

I think you're probably safer if you go out on FMLA, but it would only be temporary; once that federal protection expires, if you're on the list, you'll get hit.
