Severance Clarification Needed

So I was laid off today which was expected and looking over the severance documents, it doesn't state anything as to what happens if you get a new job during your 60 day non-working notice. I start a new job in a few weeks and was wondering how they would even know I got a new job. Last year when I was laid off as a mortgage processor, it was very clear that I would not get severance if I took a new job within that time frame however comparing the new severance docs, all of that verbiage is missing.

I got laid off from wells auto in funding department 4-8… still missing $ from the first week. What a sh-t show… we were replaced by people in Manila who can’t speak English

Don't do it.. you'll jeopardize your severance. during the 60 days non working you are still an employee and Wells will find out and there goes your severance right out the window. But if you do, then you've resigned and you get nothing

If you just do some landscape work for cash, then of course they wont know. If you get a job that pays taxes, social security etc. Then there is a big trail to follow. There are a lot of databases available that they can check. Check out sites like https://theworknumber.com

Relax for 60 days, catch up on house and yard work.

for your notice period you are considered an employee, and if you start work for another company, you will be considered to have voluntarily resigned - no severance

For those of you who think WF won't know- there's all sorts of automated stuff that goes on behind the scenes with employment verification services and stuff like that gets caught routinely. There was an article about it posted on another thread here some time ago which I don't have time to search for - but if you start another job before end of notice period, they find out even with a lag, severance can be clawed back if it's been paid out

Read my lips. Never ever, under any circumstances, tell WF that you got another job in these situations. All you are doing is giving them a chance to reclassify your departure as a voluntary resignation. Do not do it, seriously OP there is no upside.

Start the new job after the 60 day non working notice is up. You do not want to get caught lying as they will come after you for the lump sum severance. It is not worth it.

They'll know by your W-2 overlap. IRS will catch you. I know someone who got caught and forfeited all severance and had to pay a penalty for "error" (fraud), plus has to wait much longer to collect if applying for unemployment insurance in the future (less $$$). It's not worth it.

If you accept a new job that starts within 60-day period, you must resign (i.e., no severance or any remainder of 60-day pay once your new job starts).

I suggest you postpone your start date until after 60-day period ends. Also, depending on what state you reside in, severance might be paid out in alignment w/regular pay periods vs. one lump sum. So you can’t "double dip" in many states.
