HOUSTON — Exxon Mobil is facing a claim that it implemented an employee ranking system and took other efforts to eliminate older employees.

Jose Simonetty filed a complaint May 17 in Harris County District Court against Exxon Mobil Corporation alleging age discrimination.

According to his complaint, Simonetty began working for Exxon Mobil 30 years ago and on July 9, 2020, at age 62, he was terminated. He alleges that throughout his time at Exxon Mobil, he received awards and commendations for his performance and that once he turned 58 years old, he noticed "a rapid, unsubstantiated decline in his performance ranking."

Simonetty claims that Exxon placed employees in this age group in performance evaluation programs that were "essentially the last step for older employees" and "very few, if any, survive" the programs to get their employment status to the company's "acceptive level."

Simonetty further claims Exxon works to drive out employees age 60 and over in order for younger employees to advance. Specifically, Simonetty alleges that he was given a bogus safety violation to bring down his employment ranking and that Exxon hired a "substantially younger" worker for him to train as part of a plan to replace him with the younger worker.

Simonetty seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Gregg Rosenberg of Rosenberg Sprovach in Houston.

Social Security in the USA is now at 67 years old and Congress looking to up that towards 70 making it even harder for folks to retire. You young-uns pushing for the older workers to leave will see how that feels after you get divorced once or twice and put 2-3 kids through college…y’all might need to work into ur 80s hahaha y’all have no clue, just wait.

@3nia I have no doubt that you stuck around, but you definitely were not productive into your late 60s, and you definitely weren’t learning or leveraging new tools and technologies during that time.

That said, I don’t think anyone should be let go solely because of their age, although it’s a biological fact that your performance in every facet of life drops off a precipice after age 60.

Let’s stop pretending that there’s no correlation between age and performance. You get worse at most things as you get older. It’s life. You don’t have to like it, but you do have to accept it.

@2isd, you must be mad at me for sticking around until I turned 68. I was still more productive than you ever dreamed of being. I'm thinking of coming back as a contractor since the work was more fun than retirement. And I wouldn't have to use any of my $8 million in savings.

We only receive 75% of our pension at 55 years old. Why should we quit or retire until age 59 1/2 years old when we receive 100% of our pension.

Ask the Executive Committee to lower the retirement age to 50 years old and receive 100% of our pension and you will need to open the front gates for because we will be racing to exit ASAP.

This is true. I was working in Calgary out of Quarry Park at this time. I was not let go, but remember thinking to myself it was odd that my ethnic coworkers were being so disproportionately laid off. Like no doubt. Asians, African ancestry, Arabs, brown people.

Plaintiff and Defendant have sent an agreed joint motion to dismiss with prejudice to the judge on May 5th. That means the case is over, and we will never know what the true outcome is. There will be no public knowledge of whether the case settled for money or the plaintiff decided that there was no discrimination.

It’s not just older people, they use this method against people who take medical leaves that are not related to pregnancy / birth or surgery, especially anything that smells like a stress leave. During the covid layoffs in Calgary it was also clear that this was used to target non-Caucasian staff, women and any white men with neurodiversity challenges.

Happened to me...I was forced to retire by the sudden decrease on my performance evaluation after I turned 57...although, i was never given bad performance, just disnt do enought for the culture of the company. I retired at 59 just to get away from the XOM gaslighting. By the way, I was always at the top of every ranking for every company I worked at including XOM until they started the layoffs games. Just saying.

A few years ago, a local EMT told us that it is not uncommon for older EM employee to refuse medical treatment because of fear of being ranked low and losing their jobs. Admitting they have health issues means taking time off and some were fearful that others would "leap-frog over them" if they missed work.

In another instance, I had a problem with early signs of carpel tunnel because work overload. (8+ hours/day on the computer) The doctor recommended I decrease the amount of time spent on the computer. Supervisor started to pressure me to change my story to that it was a sports injury. Even to the extent to demand I send pictures of my home office and a log of my excercise frequency. I refuse.

They seem to promote the worst kind of people to supervisory roles. My advice is to leave if you are financially able. You will be much happier.

It’s obvious that they we-ponize employee assessments. The PIP increase during COVID, the lack of auditable KPIs (cultural fit - what???), etc, etc. The world hates XOM and for good reason - it’s a corrupt enterprise. Godspeed to this and other pending lawsuits. I just hope some managers are fired or face legal consequences, but I’m not holding out hope.

The way the company is trying to get away with this in the future is by pro-actively down-ranking anyone in the 50's (particularly non-diversity employees) - this way they can claim that it's performance related. Would love to see the discovery process shine some light on how employees in the 50-60 age range are ranked relative to 40-50 year olds. Would be enlightening. And lucrative for the right law firm. :-)
