Collecting Unemployment Benefits in Massachusetts

Hello Team,

I was laid off from Dell Hopkinton last week and wanted to apply for Massachusetts unemployment but stopped at the question did your employer provide severance? Is the package a severance or payment for agreeing not to take future action against Dell? Thanks in advance.

Just say yes, provide all the information. A severance will not prevent you from collecting. If you’re not really looking for new work, meeting the requirements to receive the benefits is work in and of itself.

Dell WFR Sep 2020 with severance. Started collecting Mass UI within a couple of weeks. They do inquire with former employer to confirm prev employment. I was also told it just goes through even if they don't reply. You probably paid into this over years of MASSTAX so deserve every penny of it. Good luck!

In Texas they need it to approve our deny. They changed the laws on what they believe to be severance. But after a certain period you should get it.

The big thing to look for is what the severance is for. When Dell yeeted me pre Covid it was all in lieu of any claims against them. Basically they are purchasing your cooperation which has a tangible value for them. At least I’m in MA it doesn’t stop you from unemployment. The MA unemployment form should ask you what the severance was for.

MA should pay unemployment immediately as it was not voluntary. You need the agreement in detail to send them along with, I believe, last year's tax return.

Some states count lump sum severance as your regular weekly pay so it can delay UI benefits. Check state live in rules can defer.

I was laid off from a Massachusetts company in 2020.

I was given a very generous severance package that I had to sign and return to the company. The agreement basically said I would not sue them.

I signed up immediately with Mass. unemployment and told them that I received a severance.

I had to send them a copy of the agreement and I was cleared for unemployment benefits in about a week or two.
