Thread regarding Wells Fargo & Co. layoffs

strictly hypothetical

lets say a sr manager is mentioned in a public lawsuit and an employee has information useful to plaintiffs case, perhaps showing, just as an example, that the manager has made similar comments supporting the fact thay maybe he or she really doesnt care about people with a disability. does the employee automatically get fired for speaking up?

What be strictly hypothetical ? I always believe that imprecisely substantiated delivered a more genuine smile

The WF employee would need to be deposed as part of the Plaintiff employee’s process.

This is not raise your hand territory.

Now a well crafted anonymous tip to Plaintiff’s counsel is an anonymous tip.

If you make yourself known to the plaintiff's side, then you can be legally compelled to testify. That kind of action is protected activity, its right there in the employee handbook. If there is retaliation that actually creates more issues for the offending manager. And if the annual training is true, then said offending manager is in deep trouble.

Reading at the comments making me feel go mad. There are really bad managers out there who play these dirty games (recruiting their own people, bullying, playing toxic, harassing employees, running smear campaigns.) they are noticed by management as well but why no action is taken against them. When they see a problem, the problem must be quickly ridden off.

You will put a target on your back. Are you willing to get targeted? Because it will happen, guaranteed.

If you, as any kind of manager, were aware of someone making comments like this and didnt report them then you are going to be held just as accountable as they are if you interject yourself into this situation at this point. The time for you to report this in the appropriate manner has already passed and now you're considered part of the problem as well.

If you arent a member of management at any level then you may not get disciplined for reporting what you know but it definitely isnt going to be a big boost to your career advancement or anything.

Speak up, but make sure what you actually have is actually documented. Once your name in on the legal docs the lawyers will tear you apart, and make it a he-said-she-said. They will ask where your phone to the ethics line is, where the ER case is.

Once you contact the lawyer, they are obligated to tell opposing counsel.

Can they fire you? "They" can do whatever "they" want, you are an at-will employee.
