Thread regarding Cigna layoffs

Non Compete

Can anyone direct me on where to confirm in WorkDay / HR Central if I have a non-compete in place? I recall year over year attesting to one under Express Scripts; however since moving under Evernorth a few years ago, I don’t recall signing / attesting to one and cannot find anything in Workday.

They do hold up in court but you probably signed a non-solicitation which is different. It doesn’t matter anyhow. Cigna won’t enforce it bc they are so big that they don’t go looking to find who went where, especially if they have let you go.

If you received any stock awards (LTI) then you signed a non-compete agreement. You can find it on the Fidelity stock plan page.

If you weren’t eligible for stock awards (or were but never received any), or aren’t an executive, you don’t have a non-compete agreement.

You signed a non-solicitation agreement, not a non-compete. You can't solicit former clients or coworkers who are still working at Cigna for, I think, a year. But you can find any new job you want.

  1. You’d know if you had a NC.

  2. They rarely hold up in court.

  3. They never hold up in court if the employee is dismissed.

Don't let your inability to find this document stop you from finding a job.
