Project Managers rebadging. 90% and 10% stay as GW (for now).
Consolidation under one VP + mass rebadging + downgraded benefits usually means cost restructuring and positioning the company for a transaction (sale/spin/outsourcing). Whether the “sell off” is confirmed or not, the pattern is consistent with that kind of move.

@r2 WARN act was originally designed for layoffs related to industrial plant closings, and as a result doesn't work as well as you would want for this kind of move (rebadging PMs to another company with worse pay/benefits).

The WARN açt isn't triggered unless at least 50 employees at a single site are impacted. It su-ks, but I think thats going to be a problem in holding GW accountable.

@k3 Centralized PMO to be established on 1/26. Many PMs are remaining with Gainwell under this organization to be led by Mike Weikart. No insight into numbers to be rebadged as Infinite. Business is to remain as is, with PMs supporting their current client.

So glad to be long gone...... it turned out to be such a disappointment. Now it sounds downright scary, especially for account teams, and on many levels.

Whatever discovery is made, in whatever state, I can only hope the correct people are held accountable and they don't throw one of their colleagues under the bus. Seen it happen a time or two!

@ef we all agreed that it was best to fix it ourselves rather than open a ticket case nothing ever got fixed anyway. I used to have to tell them what they needed to do when I had to. True story. I’m far from an IT person too.

@ar Yes, I am referring to the WARN act, and it absolutely does apply here. Courts have ruled consistently that employers the size of Gainwell MUST provide 60-days notice if they intend to layoff an employee OR transfer them to another company that will provide less benefits, less job protections, less pay and less time off.

Gainwell, with the transfers to Tech Mahindra is absolutely violating the law. Period. Anyone who reaches out to a good lawyer or a good state labor department will find that out.

Yes, a transfer does not necessarily qualify as a "mass layoff," but only if certain requirements are met. Gainwell is meeting none of those requirements.

Here is from an academic case study examining three cases. Bottom line is, if we want to stop the transfers and layoffs, Get a Lawyer. Gainwell will be sc--wed.

"However, it appears that an employer's notice obligations under the Act may apply where employees are transferred to new jobs and receive inferior wages or a different benefit structure. Thus, employers must continue to be mindful of their notice obligations under the Act, as the penalties for failure to comply with notice obligations under the Act are significant."

We rebadged all of our pm’s and edms this week. Companies were Tech Mahindra and Infinite. From 3 weeks vacation time to 1 week.

People not losing jobs - WTF? They are losing their lives, mental peace and no guarantee of job 6 months after rebadging - this is a sh*t horror show.
Report to local media, post on X and other social media and spread the word in the communities.

@ac You may want to research the WARN act. There is no mass layoff here, people are not losing jobs. I am guessing the WARN act is what you are referring to, if not please provide more detail.

Why is nobody here reaching out to state Departments of Labor and to labor lawyers? What Gainwell is doing with these layoffs and rebadging is 100-percent illegal. Because Gainwell employs more than 1,000 people, they are required to give as much as 90 days notice to the state before instituting these layoffs.

Rebadging or transferring employees just plain breaks the law. They have no right to do these transfers to ignore state employment laws and the fines and penalties are HUGE. It's time for each and every one of us to report this to the state labor departments.

Even more, it's time for all of us to go to local TV stations and get them to start reporting on a company that ships American Medicaid jobs to India, then breaks state law to deny proper benefits. It's a scam, and nothing will make Gainwell change it's policy faster than local TV coverage.
