Laid Off from BNY After 26 Years — No Warnings, Now Seeking Legal Help”

I was employed with Bank of New York Mellon (BNY) for approximately 26 years. Throughout my tenure, I remained in good standing with the company and maintained a consistent performance history..

During the first nine months of this year, I reported to a different manager than my current one. I completed both a beginning-of-year performance review and a mid-year performance review under this manager. In both reviews, my performance met expectations, and I was never advised of any performance concerns, deficiencies, or behavioral issues. I did not receive any verbal or written warnings, disciplinary notices, or improvement plans during that time.

My manager specifically told me that I met expectations and that he had spoken with colleagues with whom I worked directly. He stated that no negative feedback had been reported regarding my work or workplace behavior. At no time was I made aware of any issues that might jeopardize my employment. There was no documentation provided to me demonstrating poor performance or any other cause for termination.

Without prior notice, I was informed that my employment was being terminated. I was immediately instructed that I did not need to return to work for the remainder of December, and that all of my system and workplace access was removed at that same time. I was not provided with any explanation or supporting documentation demonstrating cause for termination or identifying any violations or performance concerns.

I was then told that I would receive a separation agreement by email and that I would need to sign this document in order to receive additional severance pay. Specifically, I was informed that if I signed the agreement — which includes a waiver of rights — I would receive an additional sixty (60) days of pay covering the months of January and February. I was told that if I did not sign the agreement and waive my rights, I would not receive this additional compensation.

At the time of termination, I had no pending disciplinary matters, no documented poor performance, and no warning of potential job loss. I was terminated abruptly after more than two decades of continuous service, without explanation, documentation, or an opportunity to address any alleged issues. I was effectively presented with a condition where I must waive my legal rights in order to receive severance compensation following an unexpected termination.

I am currently seeking legal representation from an employment attorney or firm that has experience representing former BNY Mellon employees or handling similar wrongful-termination and severance-rights cases involving large financial institutions. I am specifically looking for counsel who has previously dealt with situations involving long-tenured employees terminated without cause and asked to sign separation agreements to obtain severance pay.

Sorry to hear about this. Same thing happened to me in April. I was able to get another job in a nicer company and better pay and better team members. The grass is in fact greener on the other side. Even though I was only In BNY for 4 years, it is actually the worst company I have ever worked in. Believe me now I think about in hindsight, it was probably the best thing that happened to me in April.
BNY management is full of shittiest, spineless backstabbing , useless, foolish, insecure id--tic people who have no conscience. You are better off being out of there.
start looking for a job immediately as you don’t want to waste time. It takes a few months now to find another job. Good luck

@a8 sorry you were selected. Understand that your young age helps with the average age of employees laid off and nothing more. Don’t be like some of us and waste your career at BNY. Even when things were great here, they were not really great. They were not hostile, but LBNY was not a place where one could easily move up (which was likely more of a sign of the times in business). 30 year veteran here speaking.

So sorry this happened to you. This is their sc__mbag way of not paying due severance & not reporting any firings & layoffs. So they don’t report to state & local government Warn-ACT & don’t have to put it in earnings report.. They make you sign a forced resignation & dangle the bullsh-t scraps of pay in front of you. It is truly amazing that a now sociopathic led organization that is BNY, can talk about culture at all. The stench of lies from RV and his reports is eyewatering. If a person is here 26 years, that means they are doing the job, know the business, know the clients and are basically getting the job done. This lying skunk of a regime prefers to lie and hide and make up excuses. Why not be honest? Why not be professional? Why not show integrity? Tell the person we are cutting your job and going offshore. You are a gifted and valuable personan and have made countless contributiona to BNY over a period of over half your life: Thank You! We will pay you 2 years and assist you. But noooooooo… all we get is pond sc.um. The gutter has come to power at this place and soon clients will be abused the same as long time good employees.

Got laid off last week and haven't received anything in writing. When I reach out to HR, they want to call me up instead of writing back. I don't feel comfortable hopping on the phone and have their words evaporate into thin air. I need documentation, and it's really frustrating that they are refusing to even give me that.

@OP I’m sorry about this. 26 years there and thats’s how they treat you is ridiculous. This is copy and paste what happened to me and another colleague in March after being in their analyst program for 6 months. Fresh out of college. No warnings, no disciplinary issues, and performance was above and beyond. Terminated effective immediately and forced to sign a “mutual agreement” for their scrappy severance pay. They just need to discard people and don’t care how new or tenured & experienced you are. Following this page for months, this seems to be a pattern. I hope you receive the justice you deserve. BNY is going into the toilet anyways. Good luck.
