Being on payroll until January meets the WARN notice period requirement.
People who were let go are being paid as employees for the next 60 days, so there is no violation, since they will be paid for the entire notice period. California has the lowest bar for warn notices, and most other states might not even receive them.
Looking at the blog on the site it looks like they also investigate any layoffs for potential WARN act violations, so this could just be a big nothing burger.
They're gonna fight it in court and say that telling us they're reducing headcount by 10% back in September was the 60 day notice (it was very ambiguous in my opinion but a notice none the less). I'm not a lawyer but the law could get them on not saying which locations would be affected.
