Will those that are let go have to sign a non compete?

@c9 In 2015 (and since) they have made exceptions. You just need to ask for it and hopefully one of your leaders who is sad to lose you will help close the deal. If your role is likely not at any Twin Cities company, they may be more forgiving so that you could work for a Vendor and not move.
In 2015 you just had to submit a waiver to an SVP justifying why your 2 year should be cancelled. Mine and most others were approved.
I’m a designer. I was hired years ago and don’t remember signing one at time of hire. But if I’m laid off I won’t be able to work or make an income due to my niche career field, if they force a non compete. That doesn’t seem plausible. Wouldn’t that be a legal battle? Me=become homeless because Tgt says I can’t work for anyone else.
The FTC’s non-compete rule was never officially implemented due to legal challenges and has now been formally rescinded.
If your next employer asks whether you’re under a non-compete and you say yes, chances are they won’t pursue you further. They won’t know how aggressively Target might enforce it and won’t want to waste time on a potential legal issue.
My guess is that, with this many layoffs, it’ll quietly come out—wink, wink—within a month or two that Target isn’t enforcing the non-compete.
@OP it's not the non-compete that you have to worry about. Target will not grant you access to it's data in POL for 2 years after leaving the company. That is there way around the non compete laws in MN.
They have been enforcing non competes from smaller rounds of layoffs that occurred in 2023-24, not allowing those people to work directly with Target for 2+ years.
@OP No one has to sign anything - unless they want the severance offered to them. In that case, in accepting a severance, you would likely agree to not poaching TMs for a period of two years and you would not attempt to be hired back into Target for a period specified in the agreement.
If you are in MN non-competes are near impossible to enforce (via an attorney I asked about it previously when having layoff concerns).
New noncompete agreements are largely banned in MN, post 2023. Only existing agreements prior to July 2023 are valid, and only span the time of active employment.

I can confirm that in 2015 we were given the non compete and it was associated with the acceptance of our severance.
In a past layoff there may have been instances where a non compete was waived for those impacted. I also think it’s highly unlikely for target to bother going after anyone should they find out you are in violation of a non compete unless it’s a higher level or a significant financial risk.
