Has anyone ever successfully sued and won after being Irif'd? Out the 81 people released last week, only 9 were under 40.

@ab my sentiments too - if it was only 81 another larger layoff is coming. 81 makes sense though bc nothing filed with the state
If the avg age is 55 and the avg laid off was 55 then no not age discrimination.
What they need to do is get rid of all HR. They don't have a clue except for a few who know what they're doing. They promote people with a high school diploma and lied on their resume about their skills. They don't bring back any laid off EEs who were talented but prefer to hire externally. Their whole HR team is a joke. Very unprofessional.

It would be hard to prove age discrimination when the average age is so high. Young people have already left as they haven't considered staying at a company for their entire career like many of us did. In general it seems anybody born in the 90s or later stay at a company for 2-3 years then move on. At a company like Xerox with a less rosy future it's probably less than that .

Advice/considerations:
- Ask your state under FOI treatment for a list of previous settlement amounts and dates. Note this may take months.
- Recognize that if you signed the general release that your severance can be pulled back if you sue, and law firms may attempt to recoup legal fees and court costs.
- If you consider not signing the release, you still will have uphill challenges, not the least of which is finding a law firm willing to take the case. And you won’t have any severance.
@ab I belive it was close to that # and more are coming, production is soon to but extinct within big X if your job and career has had anything to do with Big Iron and your high paid yeah your days are probably numbered

Fools errand. First, XRX has fired so many people over the past 5 years you will find a normal distribution of ages within the population. Our workforce is older, so layoffs are skewed that way. Second, you will be tied up in court until after the bankruptcy and even if you get a judgement, you need to collect. Third, even with the very remote chance that you happen to collect, you attorneys will take 40% and the 60% remainder is taxable income. XRX does not target older workers, they target higher compensated workers. That might seem to be the same, but not legally. Generally, people that talk about suing have never tried it.

X tends to go after older workers. I should know. I speak from experience.
90% of the people who work at Xerox are over the age of 55. Egomaniacs who think they know everything.
