Where are the WARN notices?

There have not been any WARN notices posted in either Texas or Alaska. Is the company serious about this or just trying to get people to volunteer ahead of the layoffs.

@OP, summary on WARN from G@@gle. The quantities are by site and not by state. COP will likely “meet exceptions” for regulatory required WARN notices, but not “exceed exceptions” by providing voluntarily WARN notices to all employees as other companies may do.

The federal Worker Adjustment and Retraining Notification (WARN) Act requires employers with 100 or more employees to provide 60 days' notice before a mass layoff or plant closing. State "mini-WARN" acts may impose stricter requirements, such as lower employee thresholds.

Federal WARN Act thresholds

A covered company must provide a WARN notice in the event of a plant closing or a mass layoff. These are defined by specific employee thresholds:

Plant closing: An employment site (or operating unit) is shut down, resulting in an employment loss for 50 or more employees within a 30-day period.

Mass layoff:
Tier 1: 500 or more employees lose their jobs at a single site during a 30-day period, regardless of the workforce percentage.

Tier 2: 50 to 499 employees lose their jobs at a single site during a 30-day period, and this number constitutes at least 33% of the active workforce.

Rolling 90-day period: Employers must also issue a WARN notice if a series of smaller layoffs over 90 days meets either the plant closing or mass layoff thresholds. The losses are aggregated unless the employer can prove they resulted from "separate and distinct" actions.

@OP The TWC website just added November 4 notices (for other companies) to their Excel worksheet yesterday, so there’s likely a bit of a time lag between delivery of notices to the TWC and the public disclosure of the notice on the TWC website.

Houston employees were emailed the WARN notice last week, so it has been filed in Texas, actually.

For Nov 10, they just have to be published today by end of day. Plenty of time.
