Im going to second the previous comment. Don't make too much out of these lawsuits. The get filed all the time, and almost never amount to anything. Anyone can sue anyone else at any time for any reason. If there were an actual, active SEC investigation, that would be a different story.

I’ve seen this sort of thing dozens of times. Those lawsuits are fairly common when rich people lose a lot of money. They are also notoriously hard to prove - although there is no shortage of attorneys willing to take the gamble and file suit.
