They know the law and have good lawyers, that’s how. I don’t doubt it’s legal, but ethical, no.
Does not trigger WARN:
"If a plant closing or mass layoff results in fewer than 50 people losing
their jobs at a single site of employment;
• If 50-499 workers lose their jobs and that number is less than 33% of
the employer’s total active workforce at a single site"
Cigna laid off 1500+ last week. How did they manage that and avoid the Warn Act?
We are assuming that Cigna is jut barely legally skirting the need to file WARN notices for most of the mass layoffs.
But since the information isn't public, we can't verify that.
There is another possibility: they could be acting illegally.
I'm not saying that they are breaking the law. I'm only pointing out that other big insurance companies have gotten in trouble for not filing WARN notices, and that most of us don't have enough information to verify compliance one way or another.
It's a numbers game, I found this on the gov website under one of the conditions when WARN will be triggered: "Lays off 500 or more workers (not counting part-time workers) at a single site of employment during a 30-day period; or lays off 50-499 workers (not counting part-time workers), and these layoffs constitute 33%
of the employer’s total active workforce (not counting part-time workers) at the single site of employment;"

How does Cigna avoid the WARN notice for the recent layoffs? CVS Health is listed here with only a handful each time..
