Anyone Successfully Sue/Settle Post RIF?

Title pretty much. Anyone not sign the release and receive a favorable outcome in bringing litigation against the company?

I'm currently being discriminated against & contacting a lawyer. The lawyer said they're very familiar with the company. Apparently they discriminate all the time. I'm being treated HORRIBLY and no longer sleep at night.

There are currently 28 civil rights discrimination suits in Fedaral court from the last year. More than United, Aetna, Humana. Even per capita. Is this a problem with Elevance being more discriminatory? Is it proof that they are willing to spend the money to litigate in court? no one knows because suits that get settled out of court never become public knowledge.

To the user that said Gail doesn't like white men? Bullsh-t. Gail doesn't like anyway, but look at Pete H. ---He's not hurting. The company will do what it needs to do, they don't care about their workers and if a higher up acts inappropriately, they will protect that person and E's reputation and bottom line.

RIFs are one thing. Discrimination is another. But discrimination can but used for RIFs (Riffing an older-over 40- more experienced employee). Don't get it confused though. You can be RIFFED for legitimate business purposes. I was at Anthem for 10 years, amerigroup before that. This level of Riffing is unprecedented. Trying to bring up the stock price. Still super sh---y.

It's very hard to claim as you're 'at will' and unless you've documented multiple instances of discrimination, it's really a waste of time and money to try and sue. White guys over 50 are the first to go. Gail made it clear she doesn't like men. And, when budgets come around they ask departments to give up heads. Our VP sc--wed me over not knowing my value and also rated a 2 to justify the RIF (his words, in fact.) A 2, vs a 3 only gets you half bonus, btw, so a nice little fu very much on the way out the door.

I left early and my retention bonus wasn't even clawed back since I made it very clear that I was leaving due to being passed over for a role that a much lesser qualified person was awarded based on diversity targets. The bonus was significant too! This was a very clear case though and I'm pretty sure they were worried about a potential lawsuit.

I don’t know. According to one manager posting on this site age, pay and years of service are not a factor in RIF. Just comes down to if your manager likes you or not. I personally think age and pay are factors but all knowledgeable manager will say otherwise. But my opinion is that managers experience is just based on the area they work in and representative of all areas of the company. We need 200kpl to throw us a truth bo-b. 😀

Interestingly enough there are 2 landmark cases currently in Federal court. White guy over 40 and a black woman over 40. Hope they receive every dollar they sued for. Stay woke.

I know of a lawsuit filed for age discrimination lawsuit against the company years ago. Manager was fired due to her promoting a Hispanic woman over a white male While the settlement amount is unknown, The hispanic woman demoted a year or so later. it shows that there is hope. Settled out of court. Document everything.

50 and >20 years in, was Rif'd. They put in just enough people of different ages to make it seem like they aren't targeting older workers... when they are targeting older people who earn more.

“no one is going to sue” is false. I know for a fact associates sue after being laid off or terminated. Dont know the outcome of any cases but associates do sue.

No one is ever gonna sue because they don’t have funds to do so. Huge corporations get away with this because no one has the means to fight. There are probably people with valid cases but when you tie getting sub pay to signing away your rights, what is a person gonna do? He’ll if I had that kind of money I would have quit a long time ago.

I agree that we are “at will” employees but many getting RIF’d are in protected classes. The sub pay is based on you signing a release to not sue the company. The very reason they have that stipulation means that some getting RIF’d would have a valid case. If that is not true, why would they have you sign the release?

I thought pretty much every state was "at will" employment. If someone did sue I would think it's for some type of discrimination or retaliation not just for being rifd.
