TIAA outsourced entire teams to Accentture who in turn sent the jobs to India and hired H1B

Shame on TIAA for not supervising the transition to Accenture. Accenture manipulated the "skill gaps" matrix knowing that nobody at TIAA is going to notice. I was a contactor in Web team and Accenture replaced me with a H1B sub contractor who is not even qualified for the job and we had to do a Knowledge Sharing session with them, while there a clearly an US citizen qualified and available for the job. These jobs were not posted online or anywhere clearly denying US citizens the chance to apply. this should be a class action law suite. A few folks are planning a law suit against Accenture and also going to hold TIAA accountable for the lack of oversight

i have not seen this in 15 years of career , i work with 90% citizens and 10% H1B , H1B filed by Accenture are brightest , i have seen that and they work , when it comes to pay Accenture does not differentiate, i know folks with 200-250k on H1B working equally instead they give more , hardly seen any local on release nights , most either Indian US citizens or some 1-2 h1B stay till late , response is fast on issues , even people working on the client side want such people , i dont understand when people fail and cannot compete why they blame everyone else, skill yourself

OP was a contractor. No promises were made for non employees in this transition, and the law doesn’t protect you.

U can do few things

  1. Submit USCIS tip form under immigration misuse category. They have site visit authority now so it’s very tricky for end company and middlemen if that happens. I heard it is happening but timeline is around 3 months or so.
  2. Any job you submit, ask for recruiter legal US id and don’t accept any contract role at all. Without going In detail , this is game by Elon and gang to convert as many as full timers to contract to reduce wages and other dirty things in the name of productivity. Also, most recruiters are student or overseas which will eliminate misuse of data. 90% Indian and other students become recruiters where their visa don’t allow this type work. Other temp visa holders will be eliminated too. So less misuse of ur data. These folks do not have job but they harm your job searching prospect via games.

Did you at least get a severance package from Accenture? They were supposed to keep your tenure and pay a severance same as TIAA would have done. Especially since you didn’t last a month/4 months let alone the year or two promised.

If not I can see a class action lawsuit being feasible.

It’s nothing new or no violation of law. Most folks unhappy but problem is laws and both parties support these including currently ruling ones too.

Law says for H1b if u pay someone 60k , you are not required to post or extensive interviews etc.. like perm process. It’s a big drama and loophole only.

If any one wants to fix issue, they pass simple rule like any temp work visa holder just be paid 150% more than comparable US citizens based on location. Any job must be given to US citizens only if it require 2 to 3 months training only. That’s what offshore folks do. They train juniors on US client contracts for 6 to 8 months and than file for H1b. Most cases they don’t pay to these folks offshore but in fact they ask them to pay for trining with the hope that they will sponsor that guy’s H1b after training. It’s similar to cartel type operation.

Why no one asked simple straight question to current president regarding his H1b policy during campaign ?

The same with me. I never even got an offer and I found out my replacement is a junior subcontractor on H1B. The job was not posted, this is a direct violation of Labor laws.
