I don't think I can get fired for being a mother, but there isn't anything legal to prevent myself being laid off for a made up "poor performance" right...

TX is a right to work state. You can be the octomom and they can fire you lol
Protected leave doesn’t apply during a layoff event. If you are in scope, take it seriously and make arrangements to fully participate despite being on leave. Good luck!
A new mother needs to be home to care for her newborn. A new father has a window available in which to take his time, so probably best for a man to get through this process, be engaged, stay visible and relevant, then take the time off once in seat in a new position. I did not take paternity leave during a reorg for that very reason, maintained a job, and did not regret it. If I was a female, I would have not hesitated to take the maternity leave.
You can get laid off during an event like this just like everyone else. Make sure to communicate with your manager to make accommodations for meeting all the job selection deadlines while out on leave.

Regardless if your leave is under FMLA or not, you can still be layed off if that decision would have been the same if you weren’t on leave.
If your position is in the selection round and you are on leave then you have to choose. If you don’t choose or not selected to fill a position that results in a layoff. If you are selected for a position they must keep that position or similar one open until you return.
But…. Sounds like a good HR question.

No, if anything it would just be that your position went away. If your role isn’t eliminated and you are applying to the same role or others, they can’t hold your leave against you, but it also doesn’t benefit you either.
I don’t think the layoff is just poor performance related. Reorg, jobs going overseas. Just might not be needed anymore.
You can get fired just like any one else. But you should EOI if you want to leave. Quit if you don't want to work or can't. What's with people who are allergic to work these days and are h.ell bent on being dishonest and liars.
