Legal Recourse? Windstream severance contingent on Waiver and Release Agreement

Checking to see if there is any legal option before signing the waiver and release agreement that is contingent to receiving the separation payments.

Might as well put that energy elsewhere. HR works to protect the company and not you.

The NDA is a joke - sign it but don't honor it (if you really need the cr-ppy severance.)
I would welcome them trying to sue me for breaking the agreement - they do not want the publicity especially while prepping to sell the POS.
Probably the most important items is even if you sign you are NOT waiving your rights to file an EEOC case - that is against Federal Law. So Sign it and then in within 180 days of your final work day file and EEOC charge - good luck and you might cite DEI policies if nothing else

If I’m trying to get the answer you asked, I’d ask my attorney vs the layoff.
