Legally, during job cuts a company has to prove proof why they need h1bs during job cuts. A company should attempt to give that job to a US person before laying them off.

Based on previous ACTs, no one’s safe. They always plan this very carefully having legal teams making sure they can’t be sued for any kind of discrimination.
