Is the non-compete enforced

Years ago during the EMC acquisition Dell forced everyone to sign a non-compete. Now that we’re going thru a RIF does anyone know if those are valid? Enforced? What defines a competitor? Is it just a hardware manufacturer?

Non-compete clauses are still valid even if you've been laid off, but it's highly unlikely that Dell would try to enforce them as the courts would most likely rule against them given that you were laid off.

EMC management on certain level were extremely dishonest bunch - nepotism and the bro culture were rampant. At certain point the INS stopped reviewing any Green card applications originating from EMC Corp and I think this ban continued for at least 5 years.

Dell has lawyers up the wazoo.

Lawyers are extremely important for corporations like Oracle and Dell. Without cutting edge lawyers these corporation will meet their demise very quickly.
