Unemployment Assistance vs Severance

Anyone that have gone through RIF able to provide any details? Never heard of a company not paying severance in a lump sum and asks that you attest you're receiving unemployment weekly...

Having supported HR for decades. A few years ago Anthem took advantage of the government rules that were created in the 1950’s and 60’s to protect corporations from financial crisis when they did layoffs of Union employees.

SUB = Substitute Unemployment Benefit. It allows the company to force you to collect unemployment at the same time as Severance. The company only has to pay the difference (Severance - Unemployment = Payment). It saves the company a lot of money

I objected to the project and was eventually removed🤪

26 weeks Severance is pretty much the corporate standard these days and has been the Anthem standard for years.

Earlier posts as to what exceptions and policy are fairly accurate.

Having BEEN a long time Anthem employee I have seen the deteriorating benefits and pay.

It is not a lump sum, it is biweekly like the paycheck cycle. (As an aside, if it was a lump sum you would be taxed at a higher rate.)

Part of the reasoning for doing unemployment is the company pays into your respective state's unemployment. And the state's government changed the rules that allows the company to make you collect unemployment. I do not know if this is required for all states evil-ance employees people or not. I know mine does allow for this. Different states have different laws/rules so there are a lot of variances (ex. California requires 60 days notice for rif, NH has some different rules in regards to sick time and getting paid for it).

As to bonus-AIP, the rules have changed over the years. Last I knew if you are under 62 and have 10+ years of service you have to be employed by evil-ance on the day AIP is paid out. If you are 62+ and 10+ service years, then you will be pro-rated. In general with AIP, different orgs have different percentages they give. And, there is also some adjustments (up and down) that your boss/manager/dir/whatever can make. In the case that you are pro-rated - meaning you are not at evil-ance when AIP is paid out - your boss/mgr/dir/whatever can still make adjustments. As to what they would do is up to them. I have heard on more than one occasion that these people will give those pro-rated less, as they are not there and then give those still employed more. In most cases that I know with folks getting pro-rated AIP all they get is a check without any explanations.

I was RIF'd after the pandemic. They offered 12 weeks for my 5 + years. That came as bi-weekly pay. They screwed me and others on bonus, and since I'm a white man over 50, Gail got me out along with my boss, his boss, and any other straight white guy in her sights. It's a shame really - we've all moved on to other forward-thinking companies that don't waste MILLIONS on ridiculous initiatives. Companies that don't constantly promote their CEO in ever "best of" category out there. We all work for companies that value their employees now. Anthem/EH is an insurance company. They're not curing cancer. They're not saving the world.

@5pnq+1iVlR47f Were you able to get a lump sum payment of the supplemental or is it being paid every two weeks like a normal paycheck? From someone else that qualifies for retirement that may get caught in the upcoming Fall rifs.

I have just recently been RIF’ed and yes .. severance have long been capped to 6 months regardless of how many years of service. Can’t remember when this changed but I do know it had been some time now .. it was much better deal before.

Now as far as attesting to get your supplemental severance .. I also can say that this will be waived if you are Retirement eligible .. over 55 years of age and over 10 years of service. If you are not, then you will have to file for unemployment and do the weekly attestation. Believe you me, that is not fun …

Good luck .. and hope this helps …

Probably so you can’t claim unemployment assistance too.

For the past 25+ years, it has been capped at 6 months. There are possibly other companies that do more. There are certainly companies that do less - like IBM, theirs is around 4 weeks. Other countries have different rules.

Yep, just tells you what kind of company Anthem/Elephants Health really is....!!! I was astonished when first hearing that also. Plus, they capped it at only 6 months regardless of how many years you served in the h-ho-e.....
