Severance Emails Out

Finally received severance emails and the PDF contained a list of all jobs laid off, the department and their ages. The VAST majority of the employees laid off are over 40 years old with most over 50. This is a class action lawsuit waiting to happen. Anyone a lawyer?

In fairness, a majority of the employees working for Avaya are over 40. It's not unusual that most people let go would be those with higher salaries (working the longest) and therefore over 40. I think what's happening is sh---y - because Avaya typically hasn't cared about their employees but I don't think it matters what your age is; they don't care about ANY of their employees frankly.

20+ years in with company - not a single bad review and Hi Relative Contributor 6-8 of those years. Had run in with Director/Sr Director about them wanting to massage the truth before a message went to Executives. Basically I refused to filter the message and was told we didn't need to share the internal failures with Execs. I told them fine they could type and sent the update themselves... 2 months later I'm on list for layoffs and I'm only one on our team to get hit... Can't prove it but feels like a little retaliation for calling them out.

People. So very sorry for your loss. However....it's one thing that you've been blessed enough in your career to have no clue what the WARN act is. That's understandable. Yet when people try to help you and you snap at them like they are the ones who are clueless? There was a post last week where someone tried to prepare you all to be ready for a list with role, department and ages. The basic disclosure requirements of a Warn filing. Then a person below tried to warn you with 'Be careful', and they were blasted too, as if they were a bully. They were trying to snap sense into you so you didn't make a fool of yourself falsely claiming age discrimination. And here we are. Now you all know why they begged you to slow down, take a pause, take a breath. This is why. AVAYA followed the law to a T. Warn lists age. As you were informed last week. Stop attacking the people who care to help. Best wishes to everyone. You are not alone. Don't attack the ones who want to share and help.

They followed the WARN law. Good luck with a lawsuit. When I got my last severance notice it had the same info, but our contract with the government ended and our company got spun off to another private company that had no intention of continuing in the line of business we were in. Several younger friends (I was close to retirement) are hanging on on the remaining contracts.

I noticed was the severance package offered was cut by over 25% from the July package.
They reduced the subsidized Health insurance from 6 months max to 2 months max. With a family being cut off from health ins hurts the worst.

In addition the weeks of severance pay went from 8 weeks max in July to a max of 6 weeks.

Heck I didn't even get a call from my direct manager I just got email from corporate saying see ya later and 2 hrs later they ki---d my login access before I could send people a good bye email. Amazing thing is my direct manager had time to call all my peers to let them know I was separated..

I was laid off on 7/13 and opted the same with affected employees over 50 but none younger. I am 70, count me in.

i read be careful differently. I believe they are just guiding you to not react too quickly, as the Warn Act requires Avaya to list out roles and ages, yet it is to show those impacted as well as those not impacted. It is common for people to react, especially if they are not familiar with the policy and the law. It is a shocking thing to see if you don't have the background knowledge to understand why so many ages are listed. There was a post back from last friday where someone pointed it out. It was good advise. Now we all see why that person made it a point to mention the "2nd page" and the ages listed. This is why. And most people jump to the wrong conclusion before they understand why ages are listed.

What is the comment about “BE CAREFUL”in capitol letters about drawing conclusions? This is a natural way to think if those impacted are over 40 or 50. Why not question it at the very l least. Take a breath?

BE CAREFUL about drawing conclusions. FOLLOWING THE Warn Act, they share a list of those BOTH impacted and retained. They have reviewed this and were certain to balance it out. There is no class action....trust me. Just breathe and review again tomorrow.

My letter was 117 pages long with a spreadsheet of all the employees positions (no names) and their ages. The ages is what will get them hammered!!! They screwed up royally and now recalled the email. Too late, it has already been forwarded and printed. Lawsuit Time!!!
