If you are salaried it is not overtime. If you are hourly then report the short pay, with proof, to your state Dept of Labor.
Severance was paid in a heavily taxed lump sum based on years served and possibly your job level. There wasn't much detail provided on how they came up with the numbers last year.
For the ppl that have been laid of , did they pay severance and how was it done ? Some say they pay severance based on years, example 10 years .. 10 months of severance. Is this true?
I worked at Centene as a salaried employee for a long time before I was laid off last year. If most of us salaried people had been paid for our overtime over the years, they couldn't afford us. As a salaried employee, you are not paid by the hour, so no overtime pay. You are paid to get your job done and believe me they do not care at all how many hours that takes.
They get 40 hours of work out of me and then I am done. I do not care that I am salaried. My time and talents are valuable and I refuse work for free. They give me the work of 2 people already. The metrics are impossible to achieve. They can fire me if they don't like it.
It all depends if you are salary or hourly. Hourly, it is against the law and you can report them to HR (that comes with it's own issues/consequences). Salary ... you need to do the job and don't have a choice.
How risky is it to refuse?
