ExxonMobil used employee ranking system to eliminate older workers, suit alleges

HOUSTON — Exxon Mobil is facing a claim that it implemented an employee ranking system and took other efforts to eliminate older employees.

Jose Simonetty filed a complaint May 17 in Harris County District Court against Exxon Mobil Corporation alleging age discrimination.

According to his complaint, Simonetty began working for Exxon Mobil 30 years ago and on July 9, 2020, at age 62, he was terminated. He alleges that throughout his time at Exxon Mobil, he received awards and commendations for his performance and that once he turned 58 years old, he noticed "a rapid, unsubstantiated decline in his performance ranking."

Simonetty claims that Exxon placed employees in this age group in performance evaluation programs that were "essentially the last step for older employees" and "very few, if any, survive" the programs to get their employment status to the company's "acceptive level."

Simonetty further claims Exxon works to drive out employees age 60 and over in order for younger employees to advance. Specifically, Simonetty alleges that he was given a bogus safety violation to bring down his employment ranking and that Exxon hired a "substantially younger" worker for him to train as part of a plan to replace him with the younger worker.

Simonetty seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Gregg Rosenberg of Rosenberg Sprovach in Houston.

are you aware of any class action against EOM due to age discrimination? it seems it is quite frequent and I have a relative who might be affected by it soon

Sadly, I don't think Rosenberg has the fortitude nor bench strength to attempt classifying this atrocity as class action. Perhaps a better resourced and more interested firm wil give it a shot.

I too was ranked in the top 10% as a CL28 in my mid-50s when they executed this action to make me tank as my output and value to the corporation was increasing exponentially.

Perhaps some of the new "ESG" board members will take notice.

One of the dirty cheap tricks that the company uses at ranking time for technical people at the end of their career is to say that “at this advanced stage in your career, at this top technical CL, you should have a company-wide impact”. Of course, the “width” of the impact is strictly role-dependent, and the role is assigned, you work on what you’ve been told to, not on what you choose. You can publish peer-reviewed papers, you can present at whatever company forums exist (not many lately), but that of course supposedly doesn’t matter. To have “wide” impact you have to be given a job like some advisor, STC or Chief, which of course is reserved to the HiPos/managerial class. It’s blatant hypocrisy and discrimination, typical to EM and a monumental waste of technical resources.
Before it was the yearly humiliation of low ranking and no raises, but at least they would let you work because somebody had to. Now they PIP you, because work has no value anymore. This company sure has a bright future…

As a Supervisor, I had an excellent older employee that was well respected throughout industry and received letters of commendation from VPs. Basically the guy was technically top 10%, but was pushed to the bottom because of his age.
I had to communicate the rankings to him until one year he was so upset that he turned in his retirement notice.
It was pathetic treatment of such a well respected employee.
This downward ranking of older employees is systemic.
Not sure how that lawsuit will turn out, but it is true that EM pushes the older people down in ranking.

I wonder if Rosenberg Sprovach Law Firm will request that Jose's lawsuit be converted to a "class action" lawsuit on behalf of every employee over 55 with 25+ years of service.

This press release resonates with many senior employees over 55 years old that were PIP'd or PIL'd or forced to retire.
