Thread regarding CVS layoffs

Exempt Salaried Managers

Has anyone other than myself looked up the definition of an Exempt Salaried Manager? I found that FLSA says that if you are an Exempt Salaried Manager more than 50% of the time you should be managing one or more employees and that you should be performing duties that are exclusively managerial duties.

I know I spend at least 20 hours a week running the register, then when you add unloading and putting up truck, cleaning bathrooms, sweeping parking lots, vacuuming, planograms, BOH scans, cycle counts and quick picks and everything else that we do, we are not exempt salaried managers. We as managers are being used as cashiers just to keep the doors open not only when people call in sick but all the time because corporate keeps cutting hours. What percentage of your 45+ are you working alone??? Look up Dunkin’ Donuts class action lawsuit regarding this same topic…maybe it’s time for us to say enough is enough…

See the comment can’t fire you ! Wow maybe he or she should tell the 86 ast managers you and I fired that Tuesday they can file a claim and cvs was wrong ! Look you id--t quit telling people it will not happen to them . I was a part of doing it to them . CVS has all the judicial systems in their pocket ! They just call it restructure

Not True...They can not fire you for being part of a lawsuit - They can restructure but they can not fire. You could lose either way - might as well get paid. CVS is a sinking ship - look for something more positive for your life. CVS will never go away BUT they will never change their outlook on payroll or people. TRUST - IT IS ABOUT GREEEEED.

Managers are hired to do a job. The job includes building and retaining a team. You will need to wear many hats if you can’t staff your location. Also, I love the bootlicker comments and informative posts easily obtained on the internet. Other opportunities can also be found on the Internet. Move along and make room for someone that can handle the role.

When an attorney for CVS agrees t a settlement, they include in the agreement ,that is approved by the suing party’s attorney, that anyone and everyone ,included in the settlement ,will be immediately terminated as a part of the closure . The initiating person that starts the class action gets the lions share and his attorney. The rest get crumbs and lose job

Remember a decade ago when the ast managers were salary at CVS . Started a class action hoping to get big bucks?
CVS settled out of court , the attorney made out big time and the ast managers got 100 and then all were fired across the country the next Tuesday ! Took 3 years for them to get their 100 dollars

Look at this id--t rant on and on about how other courageous people quit taking cr-p and made a difference at another company! My advice is to quit your griping and take your sorry lazy rear end to a labor attorney. When you get there he or she will shut you down . You work at CVS and they will do what they want to you and you will take it ! That’s the truth .

California managers already went through that. They won the lawsuit or it was settled not sure which and now the majority of managers are hourly other then high volume stores.

Obviously the bootlickers have arrived and they didn’t do any homework before commenting. Even including when we go back to the pharmacy to work we are doing the jobs of a rx tech not a managers job. That isn’t a salaried exempt managers job by definition because it is non-exempt work.

Just an FYI to save you future embarrassment, EEOC has nothing to do with this you id--t. FLSA is who makes laws regarding labor standards….Workplace law isn’t determined by the EEOC. You are so ignorant that it makes me think you must be some one in corporate. The EEOC is LITERALLY Equal Employment Opportunity Commission….Call us lazy but you all are just flat out stupid. I mean wow…it just takes a google search and that would make me venture to say that you are both stupid and lazy.

Anyway, it still doesn’t go towards the 50% exempt work rule. Those of you unfamiliar with this rule, 50% of your scheduled work has to be duties that only management can preform ie exempt work, according to the FLSA (not the EEOC lol). I wonder according to mySchedule how many managers company wide are in violation of this because cvs corporate doesn’t allow enough hours of operation and we are obviously being scheduled to work as a cashier (by ourselves) until we get a second person on duty. Just food for thought.

I googled and found that Family Dollar had to pay out $54 million because the managers were made to preform “non-exempt” work more than 50% of the time.

It’s incredibly lazy that you complain on anonymous forums about suing CVS instead of taking ownership and seeking employment elsewhere. If you have any talent you should have your pick of jobs in today’s market. It’s easier to whine than find another job when you have no marketable skill set.

The real issue would be getting enough people on board. Most managers would silently and privately support any class action lawsuit, but would be afraid to put their "John hancock" on any official paperwork, and publicly join in over fear of retaliation from corporate. We all know how cvs operates under a culture of fear and threats.

This case has been presented and settled with CVS before. But apparently, they have not learned from their past mistakes, you guys have a solid case. You do not owe them anything. Take it to an attorney. It is ABUSE for what they are doing to you all.

If you are in California contact the State Labor Board. Also do some research on the Radio Shack Exempt Manager case and settlement from some years ago. It's the classic case of salary exempt manager misclassification. Unfortunately many retail companies do the same thing and get away with it because the exempt managers don't have the facts or the knowledge and just blindly follow what the company tells them to do. A true manager is salary exempt. What you are doing is a supervisors' job. You are a supervisor and should be paid hourly. If one is paid hourly then one is a supervisor. Check the legalities, good luck, and stand up for yourself. I did.
