Retaliation Case

I was laid off after complaining about harassment. I did not know about retaliation. I missed the deadline. What are my options?

You didn’t follow up with HR? Usually they call you in to discuss the matter so if HR didn’t do that, they were never notified and your manager lied to you. You probably won’t have a case based on hearsay. Everyone is just quiet enough to save their jobs right now so I highly doubt you will get any cooperation from anyone, including the EEOC or whatever agency your using.

Yes, my manager said it was taken to HR level and reported. I was not given any resolution. I just found out one day that I was laid off right after the complaint. The manager who harassed me and my manager are friends. I was not aware about retaliation at that time. Anything I can still do?

Did the retaliation occur leading up to the layoff and do you have proof? Like in my case, there was proven retaliation that led up to a forced transfer between plants backed by 3 counts of discrimination. EEOC went upon the discrimination and now I have probable cause for the retaliation. You have to do it within 180 days of your termination otherwise you don’t have anything to go on.
