Severance

I have been hearing that the company does not offer a severance/buyout anymore when they eliminate your position or close the store. Is this true?

What qualifies for a severance? I was a associate who got a severance . Nope else in my dept got it or was laid off due to Covid.

My vendor Merchandiser position is being eliminated and the company is saying that I don't qualify for Severance. If you read the Severance.pdf nowhere does it say that vendor Merchandiser positions are excluded. All that the company keeps saying is that its a transfer position. Which isn't correct because no other position pays the same, they are less pay, and no other position has a set schedule. My position literally doesn't exist anymore at the store. Corporate is trying to say that I don't qualify because there are still some people in that position AT 2 OTHER LOCATIONS and because of that I don't qualify. I've worked HR for other companies and, to be blunt, that is the most shady thing they are trying to pull. Macy's is horrible and no one is informed on proper HR policies.

It sure doesn't sound like I said Macy's has to pay or is being forced to pay severance. On the contrary, I simply explained that Macy's is smart to pay a severance instead of risking being sued, any smart company that wants to cover their behind would.

I think I understand what you are asking, it's a little complicated but I'll explain in simple terms at the beginning. Usually when a company eliminates your position, they have to offer you a similar or equal position, or offer you a severance package to compensate you if there is no such position available. Here's the options, you can take the position and all is well. If you don't take it, you are out the door with no severance package, since they can say they offered a similar/ equal position and you declined it. If there is no similar/equal position to offer you, the company gives you a severance package to compensate and you are gone.

Here's another scenario. The company eliminates your position but there is no similar/equal position to offer you. They then may give you the option to take severance package and leave, or they may offer a lower position and you stay but the ball is in your court as to what you want to do. If you decide to stay, that means that you chose to take lower position, usually at lower pay, so they don't owe you anything.

I'm not sure what your options are, but if your position is being eliminated, talk to your manager and make sure you understand clearly what your options are. Hope this helps.

I worked for one macys for 3.5 years took a year off then worked at another macys for 3.5 years.. total of 7 years.. they eliminated my women shoe position. I was making over 20 a hr plus commission.. every one else in my dept. was making 10-13 a hr...i sold the most .open the most cards and hardly ever called out.. I took macys shit and ate it.. yet they gave me the boot with a package..

@znl. Why in the world would Macy's be sued for not paying severance? There is absolutely no law that forces them to do so. On the other hand it is good that they are paying severance as @kyd explains.

Incorrect. My position was just eliminated (GOB) and I will be getting severance. There are eligibility requirements tho, so that plays a factor. My VPSM also told us it takes up to 8 weeks to get the severance checks.

I'm not sure if that is true when a store closes. As far as a position being eliminated, I would think that Macy's would still offer a severance package or offer the employee a different position if one is available. Macy's would not want to be sued or have legal trouble, so I doubt they would just eliminate someone's position without compensation. It would be much cheaper for Macy's to offer a severance package, instead of risking being sued.
That's not to say that Macy's has to offer a severance package, it differs by state, but offering a severance is much cheaper and Macy's does not want negative publicity.
If you are not in a leadership position, they would have no trouble paying you a little money to go away.
