People need the money

I see a lot of people mentioning age discrimination and how nobody is doing anything about it. And it’s pretty simple. Yes, we can all see it's age discrimination but to even have a small chance of winning on these grounds it has to be a class action suit with as many people as possible. The problem is that people need money right now more than ever if they’re being laid off. Losing a job during the pandemic and risking your severance on a lawsuit that has minuscule chances of succeeding? Why would anybody want to do that?

The problem with an age discrimination claim is that you must have evidence that the layoff was due to the employee being over 40 y/o. Since there are so many people being laid off of various ages, positions & pay grades it is almost impossible to find a “pattern” of age discrimination. Now if an employee has concrete written evidence of discriminatory comments or language used as feedback etc. that might change the game.
Also FYI when layoffs occur the company is not able to fill lost positions with those EXACT job titles for a minimum of 6 months. However they can create positions in that same pay grade with a different job title and fill those.

The catch of you read the release disclosure is that we can’t be part of any lawsuit bc we signed for our severance. It’s kinda a catch 22. If u want the money u sign and go away. If u fight it. U get nothing. My conclusion was they got rid of those who made the most for that role. Of course we are older. We worked our a– off for that money just to be let go to save money. It’s ok, I was stressing and finally figured it out and with the stimulus and unemployment. I’ll be ok. I don’t need the high dollar amount , just need to pay my bills and have a little for necessities. We will all figure out a way. ❤️

No one said they were going to sue for age discrimination, although that was a factor obviously used as well as potentially several disability cases, and not being in the inner circle and kissing butt.. If you weren’t personally affected, why are you worried about it ????? ....I haven’t seen one person say they were going to risk their severance package on a NO WIN situation... No need for a class action suit, we are intelligent enough to know that they have high powered attorneys, that no attorney would touch the case, and frankly... most companies are the same... so unless you are personally affected, have some respect and compassion for those of us that are....I have survived MUCH WORSE and will continue to be a survivor.....
