Thread regarding Centene Corp. layoffs

What does "Severance Release" form include?

As part of the most recent Centene layoff I have not yet received the Severance Release form. Does anyone know if this includes a non-compete clause? And, is there anything else specific we that are waiting should know about?

My neighbor is a labor attorney. He laughs at non compete clauses.

There was no non-compete in my Release.

If you were hired by WellCare, you signed upon your hire a restrictive covenant for up to a year. Those of us whose jobs were eliminate last year had that cut down to 6 months. That may have been true for other plans acquired by Centene as well. Make sure that you don't have that lurking.

Mine was pretty cut and dry. Listed severance details (number of weeks, COBRA) but nothing about non-compete. There is something about not suing them so basically the contract should read, “This Is Your Contract and Hush Money”. (Also you cannot sign / return it until your termination date). Best of luck to you, better things await you!

More than likely it will contain a non-compete. You may have signed one when you were hired by Centene or an acquired company called a "restrictive covenant". It will prevent you, unless restricted by state law, from working for a direct or even an indirect competitor, for a fixed period of time. It will also prevent you from recruiting anyone from Centene for that company, again, a fixed period of time.
