Unemployment in TX due to Reduction in Force

Now that we're a week or so post-layoff, has anyone filed for unemployment benefits specifically in Texas? When I check the Texas Workforce Commission website, it doesn't give a straight answer if you're entitled to benefits when you receive a severance package. My gut would say no, but I know of someone in a different field who was laid off this month and was able to file and they received a years pay.

@1rrb+18mu4TW4 - there are words for people like your pompous azz!!!! You have NO IDEA what is going on in peoples lives!!! Tenured employees, with a lot of PTO and higher salaries - some are taking care of older parents, which is a drain on them financially, physically and emotionally. Then the company awards them by letting them go. Loyalty meant something 30 years ago, I’m embarrassed to say who I worked for now. getting rid of them. Now they don’t have jobs after working for 30 years or so because they were good employees, who made good money and had a lot of PTO. I don’t usually believe in KARMA - but I hope it’s served up cold to you.

Do you also complain about people that double dip on PIP/BI med payouts? Give me a break. I mean, surely you looked at the TWC website prior to spouting something like that off, right? As I stated in one of my other replies, even the contract worker I spoke with had no clue.

To the very first poster regarding “it’s their fault,” first of all you do not know a persons finances to make that comment. Second, how do you know what they spend their money on? Lastly, your comment is insensitive so get a grip!!

If a person is getting their power cut off because they are waiting on severance and denied unemployment benefits it is their own fault. Their fault alone. Instead of buying the latest cell phone or DIRECTV and all the stuff that people waste their money on. The first thing someone should have done is set up three months emergency money. You can only look in the mirror and blame yourself if you have not saved money for a time such as this. The entitlement mantra is only a slogan for one of the political parties in this country.

The prior post is incorrect. It is not a double dip. Some states don’t consider severance connected with unemployment benefits. Someone who wrote this obviously is jealous if someone were able to succeed in severance and unemployment benefits. Each state is different and some do not consider it income but rather parting monies

I would kind of hope not. You have income (severence). Unemployment is meant for people with no income. You’re essentially trying to double dip.

I was denied unemployment in Texas due to severance. They didn’t bother to tell me either. I received a letter with how much I would get paid - if approved. I requested payment and was given nothing.

Totally agree with the Ohio poster. I and other teammates were denied unemployment because of severance. Although three others from our group termed effective the same date were approved fully for unemployment by Ohio. Those three are eating while we are days from having the power cut off.

Holy cow. Doesn't surprise me. Wonder when we'll ever see our severance money. I called TWC today, and it was some contract worker. She obviously doesn't adjudicate the claims and and had to do some keyword searching. It was obvious that she was reading from a script and really had no idea. She said it looks like we can file, up until the severance money is paid. But it was not a very reassuring call at all.

I quit and they let me work my two weeks and also paid out all my PTO within a week.

We are going through a complete nightmare in Ohio regarding our unemployment. There are four main answers and approaches being given based on who handles the unemployment claims and who is spoken to at Ohio unemployment. This is just based on my impacted area and the employees living in Ohio:

1) Full eligibility for unemployment due to the RIF with severance irrelevant and some already have been receiving weekly payments.

2) Ineligible because Allstate is reporting to the state that severance is considered living wages for the time period severance was paid. Ohio saying unemployment cannot be paid out until specific timeframe for severance passes. If your severance covers 5 months then you cannot file for 5 months after your final day's date.

3) Ohio saying you can file for unemployment regardless of severance but you just can't file for the week that the lump sum drops into your account.

4) State of Ohio is trying to get clarifications from Allstate on how and what they consider the severance to be and Allstate not responding. Weekly claims still pending due to this and in some cases going on 2 months now.

The state of Ohio is so inconsistent regarding this and people from the same impacted group are being handled totally different. Also seemingly the state of Ohio is in part blaming Allstate for unclear information and delays in responding.

This has been a complete cluster and nightmare for us here in Ohio. :(
