Lawsuit for emotional distress

According to some lawyers in Houston there is most likely a case against XOM for the way they have handled the layoffs. The courts recognize emotional distress as a type of damage that can be recovered through a civil lawsuit. This means you can sue someone for emotional trauma or distress if you can provide evidence to support your claims.

Making people wait for weeks to find out if they have a job or not is damaging to some peoples health by causing anxiety and undo stress.

@wqv+18epzEJn It's possible that perhaps these PIPs were accurately targeting low performers and you are simply interpreting ExxonMobil's strategy for shedding these folks to save money as something entirely different.

@qll+18epzEJn - XOM has had lay-offs since July. They just called it PIP and threw those employees under the bus.
I admire other oil majors for not taking that underhanded approach to layoffs.

Not sure if serious or not but this is what is wrong with america. Be grateful you've been employed this long through the downturn and pandemic. Many others in O&G have been laid off since March or worse. Let's have some perspective here please.

@exx+18epzEJn - I actually really enjoyed working as a contractor. I went back to full-time work since, but when the opportunity presents itself, I will do contract work again. My comment on the pampered nature of EM employees still stands ;-).

Something had to give with EM: they were operating as a giant bloated mess with too much overhead and dead weight for so long. It does s— that there are some talented (not dead weight) people being let go, but such is life.

No offense but toughen up, cupcake. I worked as a contractor for EM as a project engineer for two years.

A few months into the pandemic, I was told with about 6 weeks of notice that I would be replaced by an EM employee who was at that time working on a shuttered upstream project overseas. The training/handover would be about three weeks in person during the middle of a major construction project. Was I happy about it? No, I was not. But I did what I had to do and left on good terms and helped the new PE as much as I could. Did I get a severance? No I did not.

I've got to say that EM employees are some of the more pampered, entitled, and overpaid individuals I've had the pleasure of working with over the years. They really don't realize how good they have it, aside from the horrible work-life balance. It's a business at the end of the day, and business decisions were made. Nothing personal. Once you accept that, you will be more at peace.
