Disqualify for unemployment

Keep getting worst....getting a severance means you are disqualified for unemployment in TX. Can’t apply for unemployment until April 2021 when I got laid off in Nov 2020. Anyone else going through this? I didn’t know that was the guidelines in TX.

To the person who said he received unemployment pay in Texas - it is because you have only been with the company for a year. Your post is ridiculous and not relevant to tenured employees

Not 100% true. I live in Texas, worked in Texas, last day 11/28, approved for unemployment on 12/04, received my first unemployment payment about 2 weeks later and I have been receiving unemployment ever since. Now, I was only with the company 1 year so my severance was not livable under any circumstances. A denial could depend on your severance amount. A severance for $1,000 vs a severance $10,000 is a huge difference. If you haven't applied for UI yet...do it. & if it’s denied appeal their decision. It’s free to appeal & is just a little more paperwork

Let me get this straight, the company let you go and you expect them to roll over on individual state imposed unemployment laws? Please. Since your out of work, maybe you should try an educate yourself on your own states regulations. And then deal with it.

The questions regarding UI are going to deaf ears in state Employment Agencies because many are working remote, same goes for Social Security Admin. Allstate seems to have made an assumption which is not playing out for the people riffed.

In Texas, Severance is income, you are not eligible for unemployment

Allstate is telling the states that the severance is income when the state is confirming our unemployment claims with the company. Unemployment is being denied as a result as the state is basing theur decisions on what Allstate us saying. At least that is what our state told us and they saud that we need to contact Allstate if we have issues with this.

Severence is not income since you are no longer employed. It is parting monies or hush money based on years of service. It has nothing to do with income. Parting gift and unemployed is unemployed. Taking 42% right off the top before you receive it and that money will never go a year. At least the more intelligent states recognize this. Put an appeal in your state if they allow it, and advise them how heavily it was taxed. Good luck.

In Washington State you are allowed to collect unemployment in addition to the Allstate severance (there are some types of severances that disqualify you, however the terms under which we receive the severance allows collection. For example, our severance is not impacted by accepting another job offer)

That is the rule in nearly every state. Can’t double dip if you’re getting a payment for the time you’re trying to collect UI for

Severance is payment for x number of weeks. Why would you expect to collect UI while you’re being paid for those weeks?
