Do you plan on using follett's trade secrets to steal follett's customers? OMG, just threw up in my mouth. follett loses customers, is not very competitive in a dying industry and they certainly have no trade secrets! Not sure how they'd allege you're new employment is damaging them. All your lawyer would have to do is depose TL. After listening to him answer questions for 2 hours, any reasonable person would realize there isn't anything a former employee can do to hurt this sinking ship.
This would likely only be applicable if you have a contract where that’s a stipulation already or it’s included in a severance package. Only a few might have some kind of contract like that.
Yes.....Follett can't compete with Amazon.
Non compete clauses are only valid if you don't take the time to get a lawyer.
Company can't force you to not to engage in gainful employment that will support yourself and your family.
Friend of my got hit with a non compete clause and their old company paid for their lawyer, for his lawyer and a tidy sum of money for being forced to defend a frivolous lawsuit.
But, being Follett (and the family) MS will use fear and intimidation. Call their bluff if they try it. Family is made of money, you should take your share if offered!
No. Or if they do I never knew about it. I went from Barnes & Noble (BNED) to Follett and back to Barnes & Noble after a 2 week notice to Follett 1 month before Fall rush and I was a CMII.....or maybe CMIII....I honestly don't remember anymore, I pushed as much of Follett out of my mind as I could once I left.
Who is a competitor? Barnes and Noble?
