There were layoff, ah, I mean NSI quotas followed so no one group could claim discrimination. A more interesting question is for an older employee that’s always been a highly ranked performer, solid KO feedback, but handed a PIP. That scenario might be the only one that’s problematic for the company. If people think they have a basis for a claim, file with the EEOC, the more complaints they get, the deeper they will dig.

Yes I was told EM litigates everything to the end of time and cover themselves well not to look like they target any group, so not likely to get any productive outcome from suing.
Plenty of people have and also posted on this forum. Generally, unless you have physical proof that you were descriminated against (good performer last year and NSI this is not sufficient proof) your case will not stand up in court.
If you don't have actual proof, you will be wasting money chasing all this down.
