Employee Relations Investigations

How can this be right? I am part of an investigation as part of retaliation accusation and the ER investigator told me my direct report was interviewed and shared the details of what was said. Are they that terrible that they disclose that?? I hate that I don’t trust anything anymore

Report it. A third party runs the platform. Make an allegation. I can guarantee there are folks who will not put up with that BS if true. I know for a fact there are folks who will not tolerate a violation of this kind.

It’s a hostile work environment. They say it’s not but they’d prefer to ignore the issues if it means keeping their peace. Mind you it is at the cost of yours.

Here is your occasional reminder the HR/ER departments are here to protect shareholders and company exec's and not you.

ER is completely useless. After filing a complaint against my manager for documented bias and other unsubstantiated claim made by the manager, ER's response was to tell me to talk to my manager and if I still had issues to escalate to her manager.

You are the subject of the investigation

Yes if you complain they will tell everything you said, it is not confidential. And they will retaliate against you. I am not saying dont file the complaint, just be ready to fight for yourself and hold your ground. Happened to me back in 2006, I survived.

Serious doubt that this company can conduct a competent and impartial internal investigation. When has there been any evidence WF is effective at "policing itself" – ER is a sham, going through the motions to give the pretext of an investigation.

Forget filing internally. I did that and it is a big waste of time. The investigation will find nothing and they will close the case, because they are lazy. File with the EEOC for discrimination. Then, Wells will finally take you seriously. Then, if Wells retaliates, because you filed with the EEOC, you can file a second complaint - a retaliation complaint-with the EEOC. It is hard to prove discrimination, and easier to prove retaliation. The EEOC will either sue Wells on your behalf Or they will give you a right to sue letter which enables you to hire attorneys to sue on your behalf provided that you did not sign the mediation disclosure if you were hired in 2018 or thereafter. If you signed the disclosure, you will be forced into mediation with Wells attorneys and your interests will not be fairly represented. s-xual harassment cases are the only exception to forced mediation.

Refile your complaint with the EthicsLine.

If you are being retaliated against or threatened you need to file your complaint with the EthicsLine, not with ER.

Another company handles these scenarios for Wells and they are disorganized and have a lot of employee turnover. Investigators are about as well- trained as any call center employee: you might get a good one that’s been around a long time and knows their stuff, or you might get a newbie who knows just enough to be dangerous. They try to be stealth, but they interview other employees in the department in order to try to verify the validity of the complaint, and people get to talking. Very poorly handled. I am aware of a complaint that occurred in our department and I know the manager did not know the details during the investigation, but I got the impression he was told everything once the complaint was declared to be unfounded.

The investigation will likely go no where. I had a threat in writing directed at me by a leader followed by obvious retaliation because it was reported. From other leaders to HR the issue was ignored and swept under the rug. They checked off enough boxes to “close” it in their minds and I was viewed as the issue. Awful experience.
