A lawsuit is almost never a good idea when business finances support the need for layoffs. EEOC won't lead to significant damages paid to you. If you hire a private attorney they will likely take 30 to 40 percent of the AFTER TAX settlement. You're better off just taking the severance and moving on, if severance is availab!e.

Seeing this threat because my husband works here. I’m a lawyer. Please take this advice- you are an at will employee. They can fire you because they don’t like the color of your shirt.

Even if they are firing more of a certain group- that’s not evidence of discrimination. The only thing a lawsuit will do is draft out your life related to Exxon and will end with you losing. Even if you win- the damages awarded in discrimination suits are very low. It’s 100% not worth the time and effort to win even if you could.

I also don’t understand some of these posts. You’re mad because Exxon promotes based on gender or race but you shouldn’t be fired if you’re in a certain category of people? Do you merit everything to work by merit or not?!?

Seeing people drop around me left and right. Seems they all had dings with HR or were bottom ranked. Seems years of service doesn't matter. HR record does. If you were ever a trouble maker, better update your resume. Never thought I'd see this at XOM. This is only the first wave. Pretty sure I'll make it through wave 1. Wave 2, not so sure. Effin virus.

People should hire counsel if you have a case. Regarding FMLA, it is a waste of your time if you do not already have documented medical issues. The company will deny you and you will wait year to challenge in court. The best we can do is to take our stories to the media. This company caves in when it gets negative press. Anything else, they can handle with high powered lawyers. Instead of just posting on here, find a major news outlet. Any of them would love to have a story on the major O&G company

If you are on PIP, do 12 weeks of fmla. Enhance your claims. While on fmla, file an eeoc claim, it will take good 2 months to interview.

Buy time!!! Play the game!!!

You can file a cheap fmla retaliation lawsuit when they fire you, it does not cost much. Houston's Craig's list is your friend for a cheap paralegal.

Let me offer some advice by someone who has a close friend that was outright fired by them for wrong cause; if your lawyer was being honest he’d tell you to s— up your pride and move on instead of wasting years and money on this. They are one of the worlds largest businesses. They eat government lawyers for breakfast. They have the money and legal counsel to outlast you. Take this as a sign that there is better out there for you and move on.

I went to my personal attorney who discussed with the Employment expert at his firm about the Waiver for 3-month pay with no legal recourse. No regulatory recourse and other odd elements such as restrictions to Tarrant County, TX for any actions. I live and work(ed) in Louisiana.

The waiver detail would never hold up, according the them.
It's not exactly RICO level, but a class-action suit would destroy it 'on many levels.' Including attempted deprivation of federal and state protections. Not quite extortion.

There are other lawyers in Texas (where are I understand most PiPs occurred) that are currently reaching out for information and testimony. This is THEIR golden opportunity.

For my brief counsel, cost me $200. I signed the Waiver in any case.

I spoke with an attorney and sent over my full 2.5 year work history with ExxonMobil that had numerous recognition awards and spot bonuses with a run-down of what has happened lately. He told me that I was for sure getting a raw deal but legally there wasn't anything to be done without some kind smoking gun proof of discrimination. We actually discussed my PPTO time that I used this past year as I did feel some uneasiness between my supervisor over the time off to the point I was getting calls in the delivery room from my boss and being lectured about how he would use the time off it were him. Basically, we could have used that angle to file some sort of discrimination suit but it was a long shot and I did not want to go through the expense nor did I feel good about it. Overall, I was happy about the consultation and I would recommend anyone to at least speak with an employment attorney to go over your specific situation.

@Goingtostandup - Are you converting to PIL? I am on impossible PIP right now and thinking of switching to PIL the best way. According to some, as long as your supv/mgr doesn't fire you first, we can convert to PIL and get severance.

Not yet but planning too along with a trip to EEOC and possibly use some FMLA prior to my departure since my PIP is a joke and my manager doesn’t care what I do it won’t be enough as he already told me. Not to mention the signals I’ve been sent I see the writing on the wall.

Oh and he has two layers of managers above him with no direct reports. So I hope the restructure Dallas is planning cuts the fat!
