PTO hours after lay-off notification

For those who got laid off, what happened with your earned PTO hours? Does the company pay you back those hours or you completely lose them?

I was in MN and knew it was coming. Asked HR and said all would be lost. I used the PTO before they canned me.

I would research what is applicable to your state. Agree with the other comment that states only hold onto what you can carry over year to year. This is what I know. CA, you can carry over 1.5 x your total allotted PTO. MN and IL are both 40 hours.

At uhc pto is not earned it is granted which means you are lucky to get anything. They only pay you up to 40 hours.

Like others have said, the payout for PTO hours depends on the laws in your state. In a layoff situation, Minnesota requires payout of up to 40 hours of accrued PTO and anything over 40 hours is lost. California requires payout of all accrued PTO.

It's just a good idea to take your PTO and get it as close to 40 hours as possible. Besides, you can only carry over 40 hours of PTO into the next calendar year.

If you quit you lose them. I was paid for mine as part of the severance packet when i was laid off in December.

It depends on your state. I got one week and lost the rest. But some states (California, for example) require that you receive everything you have acquired.
