Leaving in the middle of PIP?

I decided to do the PIP hoping for the light at the end of tunnel. It’s clear the focus is on what’s going wrong or things the supervisor doesn’t like rather than the improvement that is happening. Not once have I seen comments about things that have “improved” but rather nick picking on minor things that have no relevance. Supervisor going around cross checking my work and asking others what my meeting were about. Holding every word under a magnifying glass. I have lost all faith and trust. Tonight was the last straw. Pinning against a team member during a call. Now that relationship has become hostile.

I am thinking about leaving. Any feedback on what happens if I leave mid PIP? Few questions: (1) will they continue to pay out till the end of PIP - original 3 months option and let me keep my benefits till end of Oct? (2) Will I be able to rollover my 401(k) to IRA? (3) What about pension funds? Can I transfer or cash out?

Being with the company for 11 years. Mid 30s.

I contacted HR about this and she confirmed what it says in the PIP, “can be terminated at any time throughout the PIP”

Just a word of caution though - Your supervisor can play games with you and terminate you first before you convert to PIL. If you get terminated (because your PIP says you can be terminated anytime during that 3 months), you get nothing. So talk nicely to your supv to convert you to PIL, instead of firing you.

Just got confirmation today from HR advisor that a PIP can be converted to PIL at anytime during a pip. You will be paid on remaining days plus any vacation days. All you have to do is tell your supervisor and they will work with an employee services case manager

According to a MLRP FAQ I’ve seen, it states that the sup is to “consult HR if an employee has less than 30 days left on the pip”. And you can convert from pip to pil and still get paid out through the remaining pip period.

Was anyone else told that conversion to PIL within the last 30 days of PIP would require an HR approval? Can they terminate you at any point in the last 30 days? Or can you resign normally and give 2 weeks notice / get paid for 2 weeks if they kick you out?

Be careful - in my letter I had to choose the options and it stated correctly once you selected, you cannot change later. I chose the option to sign of no-sue waiver, got 3 months pay and could leave immediately. If you agreed to PIP and leave - I worry they may choose not to pay you for the rest. Please check before you quit or you could lose the remainder of the 3 month pay. 401K is yours and fully vested, can be rolled over. Pension is zero unless you are 55 years old and have 15 years with the company. Be careful, check before you make any changes, they are downright rotten scoundrels.

I converted from PiP to PiL a week ago for the same reasons.

You’ll get pay and benefits until the end of your 3 months. Your unused earned 2020 vacation will be paid out.

And there are no stipulations about 401k rollover.

I would blind copy your request to your personal email as well, just to have a record of it.
PIPs are not meant to pass, it’s their way of gathering more documentation to use against you to say they tried to help you improve, and either let you go during the PIP process, or at the very end.

You have decided it is not worth fighting anymore, and no one will fault you for deciding you are done. A PIP is a lot to go through and is very stressful for you and your family.

You tried, and at least you know you tried.
Once, you are out of the situation, it will be a relief. It a roller coaster of emotions. Stay strong!! And take time to recuperate and rest.

Sorry it’s not working out for you.

From my understanding you tell your supervisor (I would do this in an email and cc their manager) you want to convert to PIL . You get what ever is remaining if the 3 months as the PIL so you’d turn in computer, badge...and collect a pay check for Sept and Oct.

The 401k you can leave as is for now and convert at any time I believe to. Do some research https://www.nerdwallet.com/blog/investing/should-you-roll-over-401k/

Call the pension line. I believe you’d have to be 50 with other criteria to cash out the pension. You can go to the benefits website and run calculators to see what you’ll get at age 55+. You will only be eligible for the pension and not the healthcare and only the annuity.
