Last day unemployment question

So today is my last day. I received the unemployment form from IBM to file. Now I am supposed to get 3 months pay as part of the separation package. Do I note that on the form when I go and apply for unemployment? My understanding is that it takes awhile to get the separation payment.

I have this question also, how do we get that paystub?
My separation payment was deposited in my account 10 days ago, but I have not received any paystub in the mail, and of course W3 login no longer works to access paystubs online.

Yes, you are required by law to report that separation pay. I did, and it didn't impact my unemployment eligibility in any way.

Illinois here. I qualified but my pension annuity was subtracted from my unemployment. Former At&t.

You (like myself) received a separation settlement (not severance pay) in exchange for a promise not to be part of a class action age discrimination law suit against IBM. In fact, nowhere in the separation agreement do they ever mention severance pay.

Furthermore, I’m in NY, and filed a claim for unemployment back in June, which was just approved last week. They were waiting for IBM to respond to a pension benefit inquiry regarding my eligibility.

The “catch” in NY is that if an employer contributed to a pension plan within the past 18 months of your employment that affects the amount (increase or decrease) of benefits you’re entitled to, then your weekly unemployment benefit will be reduced by the amount of the pension benefit you’re entitled to.

In my case, I’m in the old defined benefits pension which they froze back in 2007, so they couldn’t reduce my weekly benefit at all since they haven’t contributed to that plan in the last 18 months.

Heads up, IBM will try to consider the TDSP to be a pension plan, which it is not. ie: it falls under section 401K of the IRS code, but remember, it is a tax deferred savings (not pension) plan.

Lastly, if you weren’t entitled to unemployment benefits, then why does IBM provide you with a record of employment form for the DOL-Unemployment division?

Each state’s DOL office is currently overwhelmed by the inordinate spike in recent unemployment claims, so they need extra time to process them. Good luck and be patient.

@1qcg+16JswJNi - I'm sorry to hear that for you guys from AT&T. But, if you're reading this site you know by now that is how IBM operates. It is very unfortunate how this company keeps going downhill.

It is a mystery to most of us how IBM decides who goes and who stays, but for certain from reading all these posts here, it is not based on your performance or skills. Many here were top performers for years and years. I had fantastic reviews right up until the very end. Don't take it personally - this is decided by someone who likely never knew you or even looked up your performance numbers.

Best of luck to you and your co-workers on the next endeavors. From what I've seen, the IT market is actually not as bad as the headlines make it appear.

These are the IT folks that were outsourced from AT&T to IBM last year on 9/1/2019 (Tech Dev, others), for the Yosemite project, with a one year guarantee. Something like 42% of them just had their positions "offshored" by IBM, with 9/1/2020 as their last day.

I am one of those, and as of today I'm also unemployed. To be fair, IBM did say up front that up to half may be let go after the first year (with more to follow later), and they made good on that.

Just didnt expect top performers working on ATT cloud migration to be in the first group to be let go...

I think you can apply the the day after your employment stops. Your separation package is to protect IBM from being sued, nothing else.

Severance pay should be included on your last paycheck so I would file immediately.
Most states are backlogged so no sense adding more delay on your end.

Actually, it depends on the state. In New York, you cannot collect until you have "used up" the severance. So you definitely need to report it when you file. But don't wait, the state will let you know when you qualify to collect.

From my experience, you will qualify for unemployment on the day after your last day at IBM. The severance/separation or whatever it is now called, is basically just a "payoff" not to sue them for age discrimination. It isn't x more of weeks of salary in the state's eyes.

Most states have waiting periods once you file, so go ahead and file now and they will handle the rest. Most states right now are totally swamped with claims, so the sooner the better.

Out of curiosity, can I ask why your last day was now? I thought all the cuts were done in May/June for this year? What team were you on?

My understanding is that the 3 months is a severance package - you are receiving money to release IBM from lawsuits and agreeing to arbitration for any issues such as discrimination. It is not pay. You should file for unemployment after the 30 days of being on the payroll.
