Please check the employment laws in your state. Ensure that you know what your rights are. Because believe me, I will be doing the same. I will contact every attorney/friend that I know to get me in touch with a labor attorney to ensure that my rights are protected. It might not be necessary but I will do it anyway. It's obvious that Centene certainly doesn't have our best interests at heart. I know what I was hired for. I know what responsibilities I was hired for. I know what position I applied to. And if I get an offer outside of that scope then I should have the right to turn it down AND accept my severance! How can a company have the nerve to eliminate the position I applied for, and was hired for, and think they can offer me a position out of scope and that I would want to take it. And me somehow not taking it is a voluntary termination of employment. What kind of stupid @ss company thinks that makes sense. Centene, obviously. PROFITS OVER PEOPLE! And the alternative is only slightly better but still stupid. So HLK offers me a position. A company I didn't apply to. A position I didn't apply for. A position I didn't interview for. A company I know nothing about. A company culture I know nothing about. Company leadership I know nothing about (although I'm getting an inkling of what they are about). So this unknown entity offers me a job and if I say no that's considered voluntary termination? And I don't get my severance? So, let's weigh the options:

1) Accept a position that could be out of scope and have no bearing on my career passion from a callous company that doesn't value my work, knowledge, or experience?

2) Accept a job from an unknown company that can't really further my knowledge because they don't know anything about the healthcare industry, plus I get to work with a backstabbing succubus who once worked at the same callous company.

3) Termination with a severance package so I can begin searching for a job in this booming economy.

It's an embarrassment of riches.

Essentially it sounds like they are punishing you if you decide not to stay with them, which is very unfortunate. I think they know that most of you probably wouldn't want to stay. So the incentive is that you have to take what they are offering or you'll be left with nothing. It sounds like your only option if your offered something is to take it. lol. It's like economic blackmail. If I were in that situation there is no way I would want to stay with a company like that. They are handicapping you. Legally I think it is their right. Ethically and morally they should be ashamed. And they will probably realize that when everyone they "hire" is gone in less than 2 years. People don't forget how you treat them. Sadly your company will realize that. Once that momentum shifts it shifts quickly downhill :)

Since I'm on the outside now but trying to help–is the deal that starting in 2021, all corporate marketing will be outsourced to HLK? What have you been told about the setup and what will you have to do to transition the work–as part of your current job?

Over the next four months, will any of you be offered positions with HLK? What happens if a bona fide (VERY important–look up what that means) offer is made? How does it affect your severance? I have personally been in a situation where if I was offered a position with the acquiring company and I turned it down, my severance would be cut in half. I don't know if this would even be legal anymore in my state.

Some of you need to get together and consult with a MO labor attorney with your facts and documents lined up. Get over the shock and resentment, and look out for yourselves. Please take this from one who's been to this rodeo a few times, long before Centene and WellCare.

I’m also curious to know from an equal opportunity standpoint how does this work. HLK offers me a position but there might be a better position that I’m suited for based on my skills and experience. But I don’t get an opportunity to apply for that position? It goes to someone else? It would be different if we were talking a promotion. But that’s not what this is. These are positions being offered that we have no say in. Does not feel like an equal opportunity to me.

Absolutely right, everyone affected needs to consult with a labor attorney ASAP. Since you are in MO, there are state regulations that affect your severance package, conditions which can be applied, and things like restrictive covenants which you signed when you came on board. (And if you are WellCare legacy, that RC you signed when you onboarded DOES apply.) If you are in a different state (e.g. FL or NY), you need to consult with a local labor attorney.

That being said, my advice to you and everybody is to 1) snap up your resume and 2) think in terms of a Plan A, B, and C for you. I get that you've been blindsided, it ain't fair, and your tray is piled with the job. But 'passion' is the least of your concerns right now.

When the options are offered, look at the options on the table with a cold mind. What gives you the most runway on the job and getting paid? It might help is to think of yourself as Yourself Inc. What is the best business decision for you?

You need to be calm and have everything in front of you before you talk with a labor attorney. It won't be cheap, but it's 100% worth every penny.

I just went through this...yes, the market is tough.
