Was the NJ WARN Act triggered with the recent layoffs in NJ? If so, Nokia owes those who were laid-off more money. Normally, Nokia doesn't give a 60 day advance notice (Not even a one day advance notice.) Any lawyers out there who can help understand this better?
A termination or transfer of operations during any continuous 30-day period that results in the termination of employment of 50 or more employees
If a triggering event occurs, the employer must provide 90 days advance notice (increased from 60 days) of the termination
Under the amended NJ WARN Act, an employer will be required to pay severance in an amount equal to one week of pay for every full year of employment to affected employees, regardless of whether advance notice is provided. Currently, severance pay is required as a penalty for failing to provide WARN notice. Under the amended law, employers who fail to provide the required 90-day notice will be required to pay an additional four weeks of severance pay.
