For California, according to EDD:
"Severance pay is not wages for unemployment insurance purposes."
Also, from another source:
"If the company has a termination policy or plan to pay employees accrual of service pay for years of work, that’s probably not wage continuation pay and doesn’t affect your unemployment benefits. Wage-continuation pay that continues to accrue vacation pay, sick leave and seniority counts as wages and will affect your unemployment benefits."
Our severance therefore NOT wages nor is it wage-continuation pay.
Fill out your continued claim forms and report the severance package when you receive it and make sure it is designated correctly and you should be fine. You should collect full unemployment for that week as well. In California, earned PTO and rollover sick time was paid out in a separate deposit the night furlough began. I reported all of that for the week it happened (about $700) and it did not impact my unemployment claim for that week whatsoever. Full benefits received that week–no reductions.
Rules vary from state to state. Best wishes.
Severance is back pay so no need to file it that week as part of your unemployment. Just continue to certify your unemployment weekly as you do now. Depending on your state you will get it until you max out You might be eligible for additional 13 weeks. So if you in NY you eligible for 39 weeks total.
You have to file a whole new claim or just request payment the next week
I called New Hampshire unemployment today. They said to report the severance pay the week you get the check or direct deposit. If the payment is large enough, you won't get unemployment benefits for that week, but you can file a claim the following week to restart them.
Other states may have different rules.* NH has a help line that they set up when large numbers of people were being laid off. It is still working and I got an answer in a few minutes. Check with your own state's UI office to be sure.
Any income has to be reported. When they ask you if you made more then X you have to answer for the week your applying for. If you don't answer honestly, they will end up collecting it later with penalties.
Yes. You still request unemployment. Severance is considered back pay of wages from before furlough /layoff.
Macy’s stateD they won’t contest
Depends on the state. When you certify your weekly benefits you will answer the questions.
Thank you sooooo much do if I get severance do I report it when I'm offered it or when I actually get paid it
It is a continuation of your existing unemployment. Depending on what state you are in it will continue until you have maxed out your state benefits. You would then be eligible for the additional federal benefits of 13 weeks. The clock does not start again because you go from furlough to layoff
